Please amend statute 6107 to read as follows:
6107. Prohibited conduct during emergency.
(a) General rule.--No person shall carry a firearm upon the
public streets or upon any public property during an emergency
proclaimed by a State or municipal governmental executive
unless that person is:
(1) Actively engaged in a defense of that person's life
or property from peril or threat.
(2) Licensed to carry firearms under section 6109
(relating to licenses) or is exempt from licensing under
section 6106(b) (relating to firearms not to be carried
without a license).
(b) Seizure, taking and confiscation.--Except as otherwise
provided under subsection (a) and notwithstanding the provisions
of 35 Pa.C.S. Ch. 73 (relating to Commonwealth services) or any
other provision of law to the contrary, no firearm, accessory or
ammunition may be seized, taken or confiscated during an
emergency unless the seizure, taking or confiscation would be
authorized absent the emergency.
(c) Definitions.--As used in this section, the following
words and phrases shall have the meanings given to them in this
subsection:
"Accessory." Any scope, sight, bipod, sling, light,
magazine, clip or other related item that is attached to or
necessary for the operation of a firearm.
"Firearm." The term includes any weapon that is designed to
or may readily be converted to expel any projectile by the
action of an explosive or the frame or receiver of any weapon.

Re: reference library
The prohibition on firearm confiscation in § 6107 (b) is still current. The state park/ATV concealed carry stuff at the end of § 6109 still needs to be added, too. In fact, HB 1845 amended §§ 6105, 6106, 6107, 6109, 6110.2, 6111, 6111.1, 6117, and 6127, which all need the updates.

Re: reference library
I am curious why there has been no response to this, at all, by a mod or admin. While I am sure you are all very busy, the main point of this place is supposed to be getting correct information out there, and we have statutes in our REFERENCE library that are wrong.
How about a, "Thanks, we'll get on it first chance we get.", or even, "Read"?
I know this thread was on the index for at least the last 8 hours and it's been up two days now and it's had 50 view at this point....

Re: reference library
It’s too bad that reference library isn’t a wiki-type of section where multiple people could have modify rights to it (as in administrators and moderators, and possibly other trusted members), because as per the thread I made back in June, administrators are the only ones who have modify rights to the reference library. With all the crap the administrators have to deal with, it probably slipped through the cracks.
Besides, everybody knows the moderators need more to do!

Re: reference library
Yes, our reference library needs to be updated to reflect the most recent statutes, it's been on my TODO list.

Re: reference library
PAFOA actually had a Wiki set up at one point for testing and one day I would like to get it going again. The problem is that I don't personally have any experience with how to properly manage a Wiki and when I put out a call for people who did I got no responses (which didn't particularly surprise me.)
I just put a due date on my TODO list of sunday for Reference Library updates, I realize that I am very behind on this (among other things, ugh.)Dan P, Founder & President, Pennsylvania Firearm Owners Association
