Got stopped by a undercover that seen my gun.
Well I stop at a local gas station to put some gas im my bike, and I was carrying my taurus 651 snubby in a uncle mikes pocket holster. I dont like to carry on my hip when riding my motorcycle (this may be controversial, but its my preference). I pay for $10, the bike only takes $8 something. While I was in line waiting to get my change. I notice an undercover cop walk in the store and he stands directly behind me. He must of seen me printing, or maybe the butt of my snubby
As I get my change from the cashier, he walks outside quickly and says something on his radio and then signals for his partner, by now I'm at my bike putting on my gear ready to go as he approaches me. He says "sir, please dont put your hands in your pocket", I comply, but I also tell him that I have a license to conceal and everything is cool . He comes up to me and confiscates my firearm.
He unloades it and asks for my CCWP, and my ID, which I give to him. by now there is a marked car that is there to run all my info. He also runs my reg # on my pistol. Is this legal? the firearm was not used in a act of crime.
The whole ordeal took about 20-30mins, about 6 marked cars stopped by and left as soon as they arrived, he must of said " man with a gun" over the radio or something?
All in all they were cool cops, and apologized for the inconvenience, he said he just has to do his job.
cliffs: stopped by cops, checks my reg on my gun and ccwp
questions: is it legal to run the reg on your firearm without it being used it a act or crime or anything?Last edited by 600hpz31; June 30th, 2009 at 05:34 PM.

Re: Got stopped by a undercover that seen my gun.
Had to be the first to post that.....now for some answers to your questions.
No, it is not his job to harrass you while you were doing nothing wrong. Your rights were violated in numerous ways and you should talk to a good lawyer.
Write down as much detail as you can remember about the incident, and any name you may have gotten, as well as how long you were detained and how they took your property.
This shit has got to STOP, and the only way it will is for people to follow up on these incidents with legal means.
Please PM me.

Re: Got stopped by a undercover that seen my gun.
My new patented response to these thread questions is:
It's as legal as you allow it to be.
He will continue to be allowed to Terry stop anyone he sees with a firearm until someone who he has done it to takes him to court over it. He had no right to detain you in the first place, much less run your gun for anything, except the right to do whatever he likes because no one sued him over it..
Write down everything that happened, including dates, times, and names, consult with a civil rights lawyer, and file criminal charges for theft of property, false arrest, and whatever else you can come up with. Or be happy you are free and do nothing about it, hoping you don't have it happen again.
And that, my friends, is my last post in this thread...

Sounds more like a plain-clothes, not a UC. He'd have to be (even more of an) idiot to burn his cover in this circumstance. Good luck.

Printing is not illegal in PA. He had no cause to stop, question, or run the numbers on your firearm.

Re: Got stopped by a undercover that seen my gun.
Sorry but the SECOND you said "I have an LTCF" he should have asked for it and stopped right there .. especially since the gun was in your pocket and not accessible.
Do as HC posted, write it all down, consult with an attorney and if nothing else file a complaint with the department.

I owe you rep for that saying, let alone the rest of the post.
To the OP, the ball is in your court. Just say, "Oh, well...at least I got my gun back" or say, "I'm sick of being screwed...I'm sick of my 2A brothers and sisters being screwed...I'm not taking this any more!"
To sharpen Headcase's saying:
Someone's going to bend over and grab the ankles...will it be you or the LEO?
