A corp/LLC provides little protection to individuals intentionally breaking the law. Assuming, of course, that ATF and the feds will consider the activity illegal.
Back to the main topic, I think this is fantastic! A state actually passing a law such as this is phenomenal!

Good for them. This is some great news someone is stepping up on the offensive for gun rights.

The people saying they wouldn't want to be the test guy, are maybe missing the plan. They want him to inform the BATF that he intends to do this and get them to tell him it's illegal. That would be the basis for the lawsuit, not him actually making anything and getting arrested. At least that's how I read it....

Re: Montana sends a HUGE message to the ATF /FEDS !!! Gov Signs made in Mont. Gun Law
My thoughts :
1. Federal law, precedent, etc, etc, is all stacked against this. From my understanding Wickard (1941?) said that basically you could be building something in your basement no one else ever sees let alone buys or uses and it's still interstate commerce.
2. As Andrew Jackson said “John Marshall has made his decision, now let him enforce it.” As others have alluded to, whether it is Philly ignoring state gun laws to enforce it's own, cities and states ignoring federal immigration laws to do their own pro-illegal thing, medical marijuana etc, this is a similar type of situation. The law is only what is enforced and what people view as actually be in effect or valid. If states actually stand up to the Feds, on guns or other issues, it will come down to who has bigger fuzzy dice. Regardless of the legal technicalities this is going to be decided by politics.
3. If this became a trend and was pushed the way CC has been, it could pave the way toward getting rid of some of NFA and starting a roll back. At the very least taking positions that aim to roll back gun laws instead of just trying to prevent new ones, changes where the "middle" is when politicians make "compromises".
