    Default Hi new guy with questions

    Hi i have alot of questions for you guys I have read all your stickies but im still boggled. So I will try to make this easy as possible for you. I am 27 years old I moved to this state about two years ago. I was convicted of possesion under 50 grams when I was 17 in the state of nj(got 1 year of probation). Im pretty sure this beats me out for owning a firearm but im not quite sure I have poured over hundreds of pages of law jargain and my brain hurts So I figured the best and easiest would be to ask you guys. Im sure you have heard this before but just wanted to know. Also I have not been convicted of any crime since hell I haven't even had a traffic ticket in years and also would it even matter if I had my record expunged?

    What was the actual charge, classification, and the maximum penalty? That is what you use to determine if you are barred, not what sentence you received. For example, were you charged with a M2, with a maximum sentence of 18 months, but were given probation instead? Answer that and we can tell you.

    I should point out that I ask because it is easier to have your juvenile record sealed and/or expunged, which may cure the loss of privilege. . In New Jersey, juvenile expungements are governed by NJSA 2C:52—5; effectively, you might be able to get a 'clean slate' as an adult.

    I was charged as a juvenile. I believe it was misdemenor that's it I have to dig up the paper work to find out should have done that in the first place. Also there is an exemption clause where I would have to go to court and stand in civil court to receive an exemption to purchase a firearm but im unsure if I would have to do this in pa or nj

    ok well I have found the documents and it says violation of njs 2c:35-10 it happened 5/29/98 when i was sixteen hope someone can tell me what exactly all this means and what I need to do(like if i need to have my record expunged or get pardoned) So to all those who can help me out please do

    I am not a lawyer, I have not played one on TV, and sadly I did not sleep in a Holiday Inn Express last night. Soooo, your best bet is to discuss this matter with a competent law professional or lawyer, that is what they are schooled in, they know how to read the law books so much better that the average person. In my opinion, if you are seriously concerned about getting a gun, carry permit, restoring your gun rights, etc., contact a professional. Asking questions on this forum is a good way to start and many members may be able to get you started in the right direction but in most cases you really need the services of a legal professional.

    It will be well worth the effort to hire an attorney for this procedure. The expungement of the juvenile record effectively gives you a clean slate, like it never happened, so any dollars that you spend will be repaid in being able to check 'no' on that 'have you ever been convicted' question.
