    Default private gun sales

    Is it legal to buy a gun from a friend in PA? I assume some kinda paperwork must be done to privately transfer a gun to another person.

    For a rifle you need nothing.
    edit: as long as neither person is a "prohibited person" (legally unable to purchase a firearm ) and both are legal aged(18 or older) residents of Pennsylvania.

    Handgun, you must go to a FFL to transfer.

    Here's the thing. How do I make sure the person buying a rifle from me isn't a prohibited person? What happens if he is, lies to me and tells me he isn't, and then goes and murders someone with the rifle I just sold him?

    Use the Bill of Sale with "Buyer attests that he is able to legally buy and possess firearms." disclaimer. I'd imagine (hope) that if he lies, you'd be legally ok.

    This is why more and more you are seeing that private sellers are asking for a current LTCF or else they are going through a FFL for the transfer. Not required, but just a little bit more CYA.

    I know this makes people angry, however you could request a permit. I am willing to show mine to the person i am buying from. Even if they dont ask I offer it.

    Didn't think that the seller could be held legally responsible if the buyer lied. Not sure if that's true or not. Some one will come with the correct info, though

    One, there is nothing in thr law that says that you have to do a bill of sale for a gun being sold. Many people do one because it gives THEM peace of mind. Two, you don't even have to ask the buyer for any ID if you don't want to. The way the law states it is that if you do not have any reasonable doubt that the person is prohibited, then you cannot be held liable. I know PA Patriot has the exact section handy. I'm in Kentucky right now so I don't have my copy of the UFA handy (I know, I need to put a copy on a USB drive so I have it everywhere I go ).

    I wouldn't have a problem with showing a LTCF (That is I won't when I get one in four months). I'd much rather show a LTCF than fill out a form 4473 i.e. the de facto registration form.
