    Default Did anything change with carrying on an ATV?

    I am planning an ATV ride for tomorrow and was hoping that somehow something changed as far as carrying legally. The last threads I've seen on this were from '08 and '09

    From the UFA

    75 PA §7727. Additional limitations on operation.
    Statute text
    Except as otherwise permitted under Title 34 (relating to game), no person
    shall:
    (1) Operate or ride in any snowmobile or ATV with any bow and arrows or with
    any firearm in his possession unless it is unstrung or unloaded.
    (2) Drive or pursue any game or wildlife with a snowmobile or an ATV.

    This blows! I was hoping that stupid law would have changed. Now I can't effing carry tomorrow!

    Change has been around months to years...finally our own reference library includes it...
    18 Pa.C.S 6109:

    (m.2) Inconsistent provisions.--Notwithstanding the provisions of section 7506 (relating to violation of rules regarding conduct on Commonwealth property), 75 Pa.C.S. § 7727 (relating to additional limitations on operation) or the act of June 28, 1995 (P.L. 89, No. 18), [FN3] known as the Conservation and Natural Resources Act, and regulations promulgated under that act, a firearm may be carried as provided in subsection (a) by:
    (1) a law enforcement officer whose current identification as a law enforcement officer shall be construed as a valid license to carry a firearm; or
    (2) any licensee.
    (m.3) Construction.--Nothing in this section shall be construed to permit the hunting or harvesting of any wildlife with a firearm or ammunition not otherwise permitted by 34 Pa.C.S. (relating to game).
    (n) Definition.--As used in this section, the term "licensee" means an individual who is licensed to carry a firearm under this section.

    We REALLY need a last updated/last amended notation on our statutes in the reference library since we have no idea of the effective date of any of that.

    And we've already had several posts regarding this but I don't know where they are offhand and won't take a moment to look, having cited the above.

    6109(m.2), as quoted above, makes CC on an ATV legal irrespective of 75 PA CSA 7727. It was signed by Governor on 10/17/08 and became effective 60 days thereafter (Act 2008-131)

    PM Brown-Bear, his cousin got a $150 fine for having a loaded rifle in a ATV.....

    As well he should have because he violated the 7727 statute.

    What MDJschool posted an what I was referring to was the fact that an LTCFer can CC a 6102 type firearm (handgun, SBR, SBS) on an ATV.

    I may have misinterpreted the OP's question but I read "legally carry" as referring to handgun carry though, in retrospect, it is somewhat ambiguous and he could have been referring to longarms.

    So to clarify:

    1. CC with LTCF of handgun, SBR, SBS is OK;
    2. OC, CC w/o LTCF, or any carry of non-6102 firearm (ex: longarms) remains proscribed by 75 Pa CSA 7727.
