    Default PSP challenge

    Back in 1969 I was arrested and pleaded guilty to a 2nd degree criminal trespass which is misdemeanor less than 365 in jail in N.Y. state. I put in for my LTCF with Wayne Co. and spoke to the Sheriff and he said I should have no problem but the one I`m worried about is PSP. When and if I have to challenge the denial are there any GOTCHAs I have to worry about? I`ll thank you all now for any help now. Th

    Actually, you should be fine...LOTS of those charges floating around in that time period...

    IIRC it is not what you get / got as punishment but what the maximum allowable or possible punishment is. In other words, if the max was less than a year you would be ok. But if the law for the classification said up to 1 year and 1 month, you would not be ok.

    When you spoke to the sheriff and put in for the LTCF, he could have checked right there and then for any red flags. All the sheriff does is essentially perform a PICS type background check. You know within a couple minutes if it will fly or not. Have you bought any firearms recently? If that went well on the PICS check, I'd can't see the LTCF being denied.

    I'm going to take a stab in the dark here. I'm sure a misdemeanor back that far never got put in to a computer systems

    Just recieved my denial letter from Sheriff Dept. Reason given was that I`m a person whose character and reputation is I may be dangerous to public safety. They used the charge that I was arrested for not my conviction. Looks like I`m S O L . Now I hope that the PSP does not bust my BALLS.

    I don't believe that a sheriff (or gun dealer) can do a PICS check just to find any "red flags".

    A person has to be actually applying for a LTCF or be trying to purchase a gun before a PICS check can be initiated...as I understand it

    The PSP does not appear to be the issue but rather the sheriff.
    You just learned why not to talk to the police.

    You need to file an appeal within 30days and hire council immediately.

    Anyone know if the Wayne county sheriff is a dick?

    OP were their arrests other than the one that you were convicted for.
