    Default Is the Mini-14 NJ Legal?

    I have a Mini-14 that I bought new in NJ back circa 1989. I moved to Bucks County, PA in 1993....my brother who still lives behind the NJ Iron Curtain now wants to buy the rifle. He has a FOID card (and is a cop too). I have forgotten their laws, but I think it's legal however I'm not sure. I do recall that there is a magazine limit of 15 rounds, right? IIRC the Mini-14 was left OFF of the ban list. Of course if we do the transfer it'll go through his FFL out there, through mine. Anyone know for sure & the particulars?

    To the best of my knowledge the Mini 14 is NJ ok as long as it does NOT have a folding stock. I think you're allowed 1 "bad feature". A Mini with Rugar's original wood stock should as far as I know be ok.

    The transfer will have ti go thru an FFL.

    You are OK here with the magazine limited to 15 rounds.

    Do not use 20 round mags blocked to 15 rounds. NJSP have ruled they are illegal. I guess they have some statutory authority to make regulation on these things, but I don't know.

    Thanks guys. It has a factory wood stock, and it's not the GB model so no bayo lug to worry about. So it looks like we're good-to-go. I'll keep the 20 & 30 round mags and let him get his own mags in-state...

    TITLE 18 § 922. Unlawful acts
    (a) It shall be unlawful—
    (5) for any person (other than a licensed importer, licensed manufacturer, licensed dealer, or licensed collector) to transfer, sell, trade, give, transport, or deliver any firearm to any person (other than a licensed importer, licensed manufacturer, licensed dealer, or licensed collector) who the transferor knows or has reasonable cause to believe does not reside in (or if the person is a corporation or other business entity, does not maintain a place of business in) the State in which the transferor resides;
    NOT LEGAL under Federal law for direct transfer. Must use an FFL in any state (doesn't have to be NJ). Mag limit is 15 rnds except for registered assault rifle used for competition.

    Yep - The OP indicated they would transfer via an FFL in NJ

    Yes, I'm sending it through my FFL dealer here to his FFL dealer out in NJ.

    You can save a few bucks if you have him meet you at an FFL in PA. He fills out thye papers, they do a NIC check, pay the fee and he takes it home.
