There is LOTS of information in this thread with everyones written testimony, both Pro and anti-gun about HB 40.

It took some time to get, gather them up, scan them, along with getting them posted on PAFOA for your use. Still can't post Kim Stolfer's total 59 pages PDF that was submitted to support changing the law.

PLEASE TAKE EXTRA THE TIME TO READ THEM so you FULLY UNDERSTAND what we face..... to keep our rights.... what we fight to keep them from being taken.... DO YOUR PART, get educated about the law and your rights

Here is the Dec 2009 Allegheny County Sportsmen’s League Legislative Committee Report on the heaings

Pennsylvania House Judiciary committee holds hearing on Castle doctrine

On November 19 the Pennsylvania House Judiciary committee held a hearing on House Bill 40, the current version of Castle doctrine. This hearing was a circus that would've made the Ringling Bros. and Barnum & Bailey Circus proud. Every element was present accept the truth from those opposed this commonsense measure from prearranged and orchestrated testimony to the canned responses and the proselytizing of cease-fire PA about the concept of lost or stolen firearm reporting.

What Chairman Caltagirone was probably not counting on was the depth and breadth of supporters for this legislation and the wide ranging testimony that contradicted virtually every aspect of what cease-fire PA, the District attorneys Association, and even the Pennsylvania State police led legislators to believe.

In a remarkable development House Bill 40 was receiving additional cosponsors even during the course of the Judiciary Committee hearing which clearly indicates that the weight of testimony was on the side of gun owners and law abiding citizens.

At this time the number of cosponsors on this legislation stands at 120 House members from both sides of the aisle and all indications are that we will receive a vote on this legislation in the very near future.

As part of this effort for this hearing we once again conducted a grassroots lobbying day that was attended by nearly 30 gunowners. This effort was meant to introduce gunowners to the methods by which we use to provide information to and to educate legislators on the issue of gun control, gun ownership, violent crime and our Constitution. This effort complemented our attendance and testimony before the House Judiciary committee.

Please stay tuned to rapid developments on this legislation and for a list of cosponsors please see the Allegheny County Sportsmen's League website.

Here is the transcript of the testimony by everyone that spoke at hearing on HB 40 Judiciary Committee Nov 19, 2009

    http://www.legis.state.pa.us/cfdocs/...2009_0205T.pdf

Please take the time to read ALL of DISTRICT ATTORNEY MARSICO testimony:

Here is the part I really like, also reading the rest of the DA comments you will note his remarks on PA needing more gun control laws.

I have had situations where I have not charged drug dealers with homicide because I legitimately believe they were acting in self-defense and are self -- and had no opportunity to retreat with complete safety.

We had a case in Harrisburg where a guy was robbing another drug dealer, was pistol whipping him to the point that he was bloody, had a broken nose, was threatening to shoot him. The guy pulled out his gun, shot and killed his assailant. We didn't charge him with the homicide. He had no ability to retreat. He was backed up against a wall.

Charged him with violating the Uniform Firearms Act. Contrary to previous testimony here, we try to strictly enforce drug violence – gun violence crimes here when there's illegal carriers of firearms, and I think most of my colleagues do the same.
A review of news section you will find numerous stories on PAFOA of offenders names and pass criminals records and the lack of aggressively prosecuting repeat violators , along with the common practice of pleading away of gun charges by some DA’s in PA.

I personally know two different DA’s in western PA counties that don’t routinely plea bargain firearms charges they lock up them up and prosecute the bad guys.

here is two written statements that were entered into the record that did not testify or attend, that supported HB 40. One from an attorney and the other from a president of a sportsmen club, there may be more, this was all that was listed on web site.

I'm new to the forum and don't know how to post yet other than to reply. Hope this info is comforting.

    Tom Corbett for Governor

Tom Corbett is running for Governor because he sees a Pennsylvania where we are the standard of excellence that other states are measured against in business growth…agriculture… job creation… transportation…tourism… energy production and education.

In order for this vision to become a reality … we need a governor who has the experience and courage to make the tough decisions. We cannot afford a governor who talks tough and whose record shows that he avoids making difficult decisions and puts them off for another day-- or worse -- another election.

    · As Governor, Tom Corbett’s first order of business will be to get our state moving in the right direction and create an economic climate that allows businesses to grow and prosper.

    · We have seen what kind of economic climate Governor Rendell has created. He has raised taxes and increased spending by 40 percent. He has increased debt by 40 percent. And in the last eight years our state budget has gone from 22 billion to 28 billion. Under Governor Rendell, our state has gained about 237,000 unemployed workers with nearly 600,000 Pennsylvanians looking for work. The unemployment rate in Pennsylvania is at 9.2 percent – the highest it has been since the early 1980’s. These statistics represent real people. People in Pennsylvania are hurting. People are losing their jobs and people are losing their homes.

    · Our citizens are over taxed – we have the 11th highest tax burden in the country. And today, under Governor Rendell, we are near the bottom in the nation in job creation and near the top in taxes. Governor Rendell and Dan Onorato want to tax our citizens even more. They believe that we can tax our way to prosperity.

    · As a leader in the Sportsmen for Corbett coalition, I invite you to join me in supporting Tom Corbett as our next Governor. Tom Corbett is committed to protecting our constitutional rights, including an individual’s right to keep and bear arms. Here are a few highlights of his record:

o Since taking office as Attorney General, Tom Corbett tripled the number of concealed carry reciprocity agreements.

o He is committed to enforcing Pennsylvania laws already on the books. Recently, Tom’s office announced 34 arrests by the Philadelphia Gun Task Force, making 424 total arrests since 2006. The task force has initiated over 1,300 investigations and seized 779 firearms.

o Tom Corbett sent a notice to every District Attorney in Pennsylvania to affirm that local governments have no authority to regulate lawful firearm ownership. Local governments do not have the ability to infringe on gun ownership or possession.

o On the national front, Tom Corbett joined with many of his colleagues in signing an amicus brief supporting our fundamental right under the 2nd Amendment in the U.S. Supreme Court case regarding Chicago’s handgun ban – McDonald v. City of Chicago. You may recall he got involved in a similar case two years ago and was successful in urging the high court to strike down Washington D.C.’s 32-year-old ban on handguns in DC v. Heller.

    · Tom Corbett has a vision and a plan to turn our economy around. It does not include more taxes and spending-- nor does it see the government as the solution to every problem. His economic plan will unleash the power of the private sector. The foundation of his plan is based upon three tried and true principles.

    · Fiscal discipline

    · Limited government

    · Free enterprise

    · Tom Corbett will bring fiscal discipline to state government – developing commonsense budgets, control spending and eliminate waste. That’s why he signed a no new tax pledge – the people of Pennsylvania are taxed too much and should not have to pay more for government greed.

    · Dan Onorato has not and will not sign that pledge to protect the taxpayers of Pennsylvania. It is not surprising since he implemented the largest tax increase in the history of Allegheny County. And in this campaign he is calling for even more taxes and more spending. Dan Onorato shares the same tax and spend philosophy as Governor Rendell. And since Dan Onorato took office, more than 20,000 people have been added to the number of unemployed workers in his county. He has no plan and no vision for Pennsylvania.

    · Second … Tom Corbett will guide his administration with limited government. He believes that we need to shrink the size of state government and reduce the burdensome regulations that stifle business growth and job creation. Tom Corbett has released a detailed plan to reform state government that he will take to the legislature during his first week in office. His plan calls for the elimination of the way per diems are paid …reduction of state cars … and restoring integrity to government.

    · The third and final principle for Tom Corbett’s economic plan is the promotion of our free enterprise system. He believes in the creation of private sector jobs over government jobs.

    · Tom Corbett believes that we need to reduce taxes to spur job growth – not raise them. He has released a detailed jobs and economic development plan that will reduce the corporate net income tax to 6.99 percent … remove the net operating loss cap… phase out the capital stock and franchise tax… and phase out the inheritance or death tax, which impacts our small businesses and family farms.

    · Tom Corbett is going to work for meaningful legal reform, including passage of the fair share act and placing caps on noneconomic damages.

    · Tom Corbett also has released his plans to reform Pennsylvania’s burdensome regulatory climate and eliminate the permit backlog at state agencies… in particular at DEP and PennDOT.

To achieve this meaningful reform and make job creation a top priority … we need a governor with a vision and who is a proven leader. Tom Corbett has shown his leadership as Attorney General. From fighting to protect our children from Internet predators to cleaning up the culture of corruption in Harrisburg to protecting our senior citizens from scam artists – he has dedicated his life to serving the people of Pennsylvania.

It will take leadership and courage to get Pennsylvania back on the right track … and Tom Corbett is the only candidate for Governor who has the experience and proven leadership to do what is in the best interest of Pennsylvania. He has a vision for Pennsylvania where we are the standard of excellence that other states are measured against. Tom Corbett knows that we have the people and we have the resources to make this vision a reality. What we need is a governor with a plan and the courage to lead the way.

    · As Governor, Tom Corbett will fight for and protect the freedoms we hold most dear, just as he has done as Attorney General. Please join me in supporting Tom Corbett as our next Governor on Tuesday, November 2nd.
