This would be the beginning of the End for the Internet as we know it. Wonder what they would do if we were to start encrypting our connections and use tor routers.

Unfortanately this isn't just an Obama thing. International "discussions" on copyright are often held in secret

What is interesting is that from the sounds of it, this will effectively revoke the protections given to ISPs under Title II of the DCMA (which provides ISPs with "safe harbour" protections under certain guidelines). If this is indeed the case, then would the executive order (in all or in part) be constitutional? Easy, depending.
You are always relying on trust in the "person" you're connecting to for secrecy.
But, let's say you and your buddy, Bob Smith, want to create an encrypted connection between you so that you can share files with each other in relative obscurity.
All you need is a point-to-point encrypted VPN, and several appliances exist that can accomplish that. All the government will see is encrypted traffic going back and forth, but they will not see any of the contents.
Most COTS VPN appliances support 128 or 256bit encryption, and in both cases, you will be long dead and gone before the information you share could be compromised.
Your situation will obviously depend on Bob not rolling over on you, but in case he does, you need to add some local defense against prying eyes. This is where whole-disk encryption comes into play. There is a free program called TrueCrypt that can apply strong two-factor encryption to all of your local disk resources. So, if Bob rolls over on you and the FBI comes and takes your computers, they will not be able to find any evidence of wrongdoing on them.
You cannot be compelled by the government to give up your encryption keys, either, because that amounts to self-incrimination. I also don't believe there have been any cases where the government has been successful in arguing that they should be allowed to hold someone in custody without any evidence while they try to break the encryption.
