Hope he enjoys his time in the Rock while awaiting trial.

Unless he was a prohibited person before this incident and not legally able to get a LTCF or possess a gun in the first place

    Yes.......

In the criminal code of Pennsylvania, there is a crime called "Disarming law enforcement officer" which you can find at Title 18 Section 5104.1 of the Code.

This law was passed recently (effective in 2006) and there has been very little litigation in the appellate courts over what the statute means. It is clear that if someone either attempts or does in fact take a gun or other weapon away from a police officer, that person commits a felony of the third degree. The statute does not define the term 'weapon'.

Yes, it's one of those many cop superpowers they get...

If an irresponsible gun owner allows themselves to be stripped of their weapon by a criminal, they can potentially get charged with loaning a firearm to a prohibited person and loaning to a person without an LTCF. (Both would be BS charges, but a DA could still do it)

The cop gets off scot-free, as usual, without any consequences for failure to keep their firearm secured and for putting the general public in danger by allowing a criminal to have a firearm.

Police have identified the man who allegedly assaulted a trooper and tried to take his gun during an altercation in Brownsville Tuesday afternoon.

Christopher Stevan Roseman, 30, of Bentleyville was charged before Magisterial District Judge Ronald J. Haggerty Sr. with aggravated assault of a police officer, disarming a law enforcement officer, resisting arrest, receiving stolen property, carrying a firearm without a license, illegal possession of a firearm, simple assault, possession with intent to deliver cocaine, possession of marijuana, tampering with evidence, criminal mischief and multiple traffic violations.

Police said the incident began shortly after 1 p.m. on Redstone Way in Redstone Township.

Trooper Steven Walters spotted Roseman driving a vehicle that appeared to have the inspection and registration stickers concealed from view, police said. Walters conducted a traffic stop on Roseman's vehicle at the intersection of Sixth and Church streets, police said.

During the stop, Walters said that he noticed the smell of marijuana emanating from the car and asked Roseman if he could search the vehicle.

Walters then discovered a marijuana cigarette on the passenger seat of the vehicle. Walters also found a duffel bag with marijuana sticking out of the bag, police said.

Police said that then tried to place Roseman into custody but he began to struggle with Walters, and during the fight tried to take Walters' duty weapon from his holster.

At some point in the struggle, police said Roseman was able to take the bag from the car and started to run.

While he was running, a handgun fell out of the bag onto the road, police said.

Police said Walters then used his Taser gun to shoot Roseman but Roseman was able to pull the Taser probes from his body and continue to flee. Walters caught up to Roseman and used a baton and later pepper spray to try and subdue him, both to no avail.

Police said that two men working nearby assisted Walters in taking Roseman to the ground and placing him into custody.

While he was on the ground, police said Roseman tried to destroy a plastic bag of cocaine that was inside the duffel bag.

Police said that the suspect was taken to Monongahela Valley Hospital in Carroll Township, Washington County, for treatment of injuries sustained in the struggle.

During an interview with police Tuesday night, Roseman admitted to buying the cocaine early Tuesday in Pittsburgh for resale, police said.

He also admitted that he purchased the stolen handgun in 2008, police said. Police said investigators learned that the weapon was reported stolen from a home invasion in Uniontown in 2008.

He also admitted to trying to destroy the cocaine because he was "scared and didn't want to get in trouble," while he was being placed in custody, police said.

Roseman was convicted of concealing a deadly weapon in Maryland in 2001, forbidding him to possess a firearm.

According to Washington County Court records, Roseman was charged in April by then-East Bethlehem Township police Officer Travis Shandor with aggravated assault, escape, recklessly endangering another person and several other charges.

Shandor, who now works for the Uniontown Police Department, said the charges were filed after Roseman ran from police following an assault.

The charges were held for court in late April, however, a trial date has not been set. Roseman was placed in the Fayette County Prison on $50,000 straight cash bond following his arraignment.

A preliminary hearing will be held at a later date before Magisterial District Judge Michael Defino.

BS, Show me one case where a private citizen was disarmed during an attack and charged by a DA.

BS an investigation would be held and if there is any negligence on the part of the LE there could be consequences.

Just to clarify... it seems that the bad guy did not actually get the trooper's gun according to the story.

Apparently, just by attempting to get it... he can be charged with "disarming a law enforcement officer".
