    Default Spoke to a Lawyer in Lancaster, PA

    This thread is running in the Lancaster section as well because I'm curious about specifics to Lancaster.

    I called a criminal defense lawyer about CCW/Self-Defense just to ask a few questions and to figure some things out.

    He tells me that the LTCF issued in Lancaster County is not valid in Philadelphia...that sounds contrary to what I've heard in the past. Has a law changed or is this guy out of his mind that I can't concealed carry with my Lancaster permit in Philadelphia?

    Anyone else heard of anything like this with their permits?

    If you ever need a lawyer for more than asking questions... Don't go to that guy. He/She obviously does not know the Unified Firearms Act as that is the foundation for everything firearms in PA.

    The only thing special about Philadelphia is its Class One city designation. Meaning that is the only place in Pennsylvania that requires a permit (LTCF) for open carry. [Open carry everywhere else is legal without a LTCF]

    Your PA LTCF regardless of where or who issued it is still a valid permit for the entire state.

    I thought he was wrong and pitched his number as soon as I hung up with him. Just wanted to make sure. Not that I blindly accept whatever people on internet forums say, but something this basic is more than likely something that you guys would know for sure.

    Indeed -- a good rule of thumb is not to retain a self-defense attorney who knows less about the relevant law than you do!

    8 Pennsylvania Consolidated Statutes Annotated § 6108 prohibits carrying a firearm, rifle or shotgun "at any time upon the public streets or upon any public property in a city of the first class" (cities with a population of one million or more, per 53 Pa. Stat. Ann. § 101) unless the person is licensed to carry a firearm (18 Pa. Cons. Stat. Ann. § 6109) or, as discussed below, is exempt under section 6106.

    The lawyer gave you bad information.

    Nah, I just don't make it a habit to trust everything people say about the law and politics.

    It's my responsibility to make sure I'm educated with the correct information...that's all.
