    Default If the police wrongfully raid you???

    I have seen a lot of this happening, quite a few of us made statements knowing we are innocent and hearing someone kicking in our door wouldnt react, shall we say politely.

    It happened within the last few years to my mother, who lives next door. 7 AM on New Year's Day, and that's all I can share thanks to non-disclosure. By the way, excellent trigger discipline from the lead officer.

    The police had to gun down a guy in his home last week down in butler about a half block from my exwifes house. I guess the guy snapped and was shooting up his house.

    Problem was.. police fired teargas into the wrong house.. one of the neighbors. The guy is still stuck in a hotel due to the fumes and damage.

    Thats some scary crap.

    I mean in the middle of the night.. if your home asleep.. your not a criminal.. how do you know that all the banging and crashing you hear coming through your door is really the police? what cause their yelling "police officer.. search warrant"?

    Yea anyone can do that. No knock warrants are dangerous.

    and how would you know that the cops aren't criminals, themselves? (ie: even if they are cops...)

    Well this is a very simple senario. Considering me and nobody in my house is a criminal, I would not expect the police to kick in my door. Therefore I would treat it as any other BG kicking in my door.

    I hope if this was to ever happen, for everyones sake I would see some marked police cars outside first.

    In the absence of crime, any police raid on my home would be by mistake.

    I know that I am committing no crimes.

    I also know that the local police here, and the State Police, and the Federal DEA/FBI/Homeland Security, are all trained professionals who would not kick in my door by mistake.

    Accordingly, anyone kicking in my door will be a criminal intent on doing me harm, since I would undoubtedly communicate the fact that I'm home as they break in, so this rules out any possibility of them being unarmed criminals who just want to steal stuff. If they break in KNOWING that I'm home, a reasonable person in my shoes would know that they feel capable of neutralizing me, which means that I am in reasonable fear for my life, and in fear for the safety of the others in my home.

    That's an affirmative defense if you use deadly force to stop the intrusion. Sure, the survivors will testify that they "identified themselves as police officers", but there's a growing trend of bloodthirsty gangbangers doing exactly the same.

    This is one of my biggest fears. My family gets shot up because of a mistake. Their mistake.
