    very good thread, informative.philly should not need a ptcf due to pre emption. only the state makes laws. not cities.

    Don't you mean it's a state law that applies to Cities of First Class; and Philly is currently the only such city ?

    Although both of the above are pragmatically correct, one might look to the statue to see some potential conflict:

    18 Pa CS § 6108. Carrying firearms on public streets or public property in Philadelphia.

    No person shall carry a firearm, rifle or shotgun at any time upon the public streets or upon any public property in a city of the first class unless:

    (1) such person is licensed to carry a firearm; or


    (2) such person is exempt from licensing under section 6106(b) of this title (relating to firearms not to be carried without a license).
    Obviously the Legislature considered the two terms as synonyms since, at least for the foreseeable future, only Philly has the requisite population to qualify. Nonetheless one of the canons of statutory construction gives emphasis to 'city of the first class' to the detriment of 'Philadelphia':

    1 Pa CS § 1924. Construction of titles, preambles, provisos, exceptions and headings.

    The title and preamble of a statute may be considered in the construction thereof. Provisos shall be construed to limit rather than to extend the operation of the clauses to which they refer. Exceptions expressed in a statute shall be construed to exclude all others. The headings prefixed to titles, parts, articles, chapters, sections and other divisions of a statute shall not be considered to control but may be used to aid in the construction thereof.
