When there is a drunk crackpot holed up in his house with a .38 revolver then of course 50 cops need AR-15s with "high capacity" magazines. But when 4 criminals kick in the door to my home nobody should need a gun like that or magazines over 10 rounds.

I've been saying this since the Obama campaign came out with the idea that "assault weapons" should be banned because they "belong on foreign battlefields, not the streets of America". Taken at face value this would also call for disarming LEOs because they police America's streets, not foreign battlefields.

Ummm..yeah, this thread didn't go where I thought it would, but a few points:
Someone else can cite this, but we are not without court decisions that support our right to own weapons intended for the waging of war, because that is their ultimate purpose.

Current state AWBs, NY for example, exempts LEOs with no stipulation that the weapon be a duty weapon. Now some departments restrict the officer's permission to have them, but they can buy pistols, non-AWB ban compliant guns and high cap mags for them on thier badge, regardless of Department policy or whether they will actually ever use it on duty. When they retire that stuff is supposed to be turned in, but a department upstate currently is missing some machine guns...so we know how that goes...

Been like this since the NFA of 1934 and the GCA of 1968 and all laws since. Nothing new here.

Just because it's the status quo doesn't make it right. Both the GCA of 1968 and the NFA of 1934 are morally reprehensible.

True, but nothing changing anytime soon, least in our lifetimes. Just being a realist.

All that needs to be done is for the commerce clause of the Constitution to be revisited by the supreme court, and reigned in. Not only would that invalidate just about every federal gun law, it would also void ~90% of other federal laws, as it should be.
