    Default firearms denial due to a misdemeanor DUI

    I was denied firearms purchasing which I thought was from a dui i recieved back in 1995 (it's been a while since I bought one). I consulted a lawyer yesterday about it, he said that will not stop me from purchasing one. I went home and called the state police they said it could be a mistaken identy or incorrect paperwork, I got a copy of the charge and sentance today and am taking it up to Harrisburg tommorrow. Has anyone else had this happen.

    Any input would be great.

    You need to do the denial challenge paperwork NOW. It will go through the system and you will be cleared or not. If not, I believe it will say why. It very well could have been that your name or other info is very close to someone else's that has a prohibiting factor or possibly someone else's info got into one of your records by mistake. That's why it is imperative that you do the challenge paperwork as soon as possible after a denial.

    I have all the paper work and filled out the challange sheet and i'm driving up to PSP in Harrisburg tommorrow.

    Just overnight/registered mail it. Driving is a waste unless tomorrow is the deadline. More than likely it will be a week before they can give a reversal.

    just make sure it was an M2 DUI and not an M1... if its the M1, you can fill out your paperwork, but it isnt going to make a difference. M1 in PA = felony in the fed's eyes.

    did you receive an ARD with this DUI. if so you may be elligable to petition the court to expunge the matter. you could do it pro se very cheap.
