    Default My brother in-law needs help!

    The poor son of a bitch lives in Cali. Its tough to Have any fun out there. He was wondering if there was any way to "legally" own hi cap mags. I did some research and found out that if he owned any pre 2000 he could keep them and possibly use them. Is that correct? Also he might be able to purchase parts to repair pre ban mags. What would keep him from purchasing all the parts to re- build a mag or just build one. I know most of the people aren't lawyers here just looking for some advice to cheer up a fellow gun fanatic. Also how much trouble can you get in if one decided to buy one outside of cali and bring it in?

    Don't know the laws in CA but if he were to buy all the parts to build one he would still be breaking the law (putting the pieces together, no matter how old they were still makes it a new high capacity magazine). I am not sure if they grandfathered high caps made 2000 or before. He would need to get in touch with gun people out there for the best answer.

    You would also get in trouble if you bought from outside and brought in, you still can't own them unless you preowned them before the ban (I think). If you check the different places that sell magazines (CDNN, CTD, SG, etc) they all will have disclaimers that said that the hi caps can't be sold or shipped to CA, so going to Nevada and buying and taking across the state line is breaking the law.

    Sorry, no hi caps for him it looks like.

    Pretty sure he could buy preban mags or "mag rebuild kits" like 44mag.com sells. Important piece is having a date stamped mag body.

    this is incorrect, unless you KNOW the law, please do not make illegal suggestions.

    the important piece is below...DATE OF POSESSION.

    the Cali hicap ban went into effect 1/1/2000

    only those hicaps currently owned may be posessed and used

    importing further hicaps past what was posessed on 1/1/2000 in Cali is a FELONY.

    he may rebuild old hicaps, however, mag rebuild kits are for rebuilding magazines, not for assembling new hicaps, when rebuilding, the old parts must be destroyed. Assembling new is same as importing, a felony.

    basically, your BIL is screwed, his only option is to move to a free state, there is no legal way for him to acquire hicaps as a civilian in Cali.

    again, dont suggest illegalities here.
