    Default Dead grandparents pistol gift

    Hi,

    My grandpa, from Ohio, bought a pistol in the mid 80's and has since died. My mother (his daughter), received his pistol from his estate with the intent of giving it to me when I became of age, which they have done. I don't believe any formal record of transfer was conducted.

    Should there be? I don't know how this works across state lines.

    First step: the bequested firearm. (assuming your mom is PA resident) If your mom was the rightful heir via a will or executor of estate distribution, no interstate paperwork is necessary if it went from grandpa/estate(OH), across state lines to your mom(PA). It is one of the federal exemptions. It is also exempted under PA law too via bequest.


    The second step, the gift to you: Since your mom was the rightful and lawful owner and assuming she is a resident of PA like you, she can give it to you without any paperwork because of PA's exemption for the certain direct family members.


    ....so, no paperwork necessary if your situation mirrors how I detailed thing above.

    If your mother is a resident of PA and your a resident of PA she can just give it to you in PA.

    Your grandfather gave you a greater gift than you might possibly realize.

    Guns without paper are awfully difficult for a government to unlawfully confiscate.

    Small piece of advice: I don't care if you need a freaking kidney transplant, your house is getting repossesed or you have an opportunity to bang Air Force Amy for money. DON"T sell that gun under any circumstances.
