    Default Denied in Philadelphia

    I just received a denial for my right to carry a firearm in Philly. I am trying to decide if a challenge is worth it.

    Doesn't the letter show some detail as to the reason for denial?

    18 PA CSA §6109(g) Grant or denial of license.--Upon the receipt of an application for a license to carry a firearm, the sheriff shall, within 45 days, issue or refuse to issue a license on the basis of the investigation under subsection (d) and the accuracy of the information contained in the application. If the sheriff refuses to issue a license, the sheriff shall notify the applicant in writing of the refusal and the specific reasons. The notice shall be sent by certified mail to the applicant at the address set forth in the application.

    The only problem with the law is - when the issuing agent denies on the grounds of a PICS denial, PICS doesn't tell the agent what is the prohibiting factor.

    The medical thing is common, it is to evaluate any mental health things like having a 302, 303, etc. It isn't about physical sickness/injury.

    If you have NO prohibiting convictions or haven't been involuntarily instituted or adjudicated mentally defective - they will reverse the denial.

    The prohibitors for a License To Carry is slightly more strict than purchase of a firearm. One of which is ANY violation of the Drug & Cosmetics Act - even summary offenses is a prohibitor. There are a couple other things that are more strict.


    You need to think good and hard before sending in the challenge.

    Sometimes these denials are because of similarity in name to someone else that is prohibited.

    I think the most overlooked reason for denial is medical marihuana cards. I think most denials would know why they're denied otherwise, unless there was a mistake.

    I did it online and the email is just an automated response with no explanation.

    I hope someone is fighting to change the law so PICS has to give you a copy of the report on which your denial was based.
