    Default Possession by prohibited person... (almost)

    Hey, me again. Long time listener, first time caller.

    Just heard about a sketchy arrest I don't like.

    Facts:
    Hot shot cop pulls car over for window tint and expired FLA temp tag.
    Male driver/vehicle owner is temporarily prohibited from possessing due to PFA which expires next month. Female front seat passenger has valid FLA LTCF. Female front seat passenger advises her pistol is in the center console. ROS check confirms it's her gun. Hot shot arrests male driver for possession by prohibited person.

    Yea, she shouldn't have said anything when cop asked if there were any weapons in the car. But IMO, this guy is prohibited for the next 29 days because a judge believed a crazy ex, not because he's got a criminal record. Not my call, but if I were the supervisor at the scene, I would've told the passenger to keep the gun on her person and out of reach from the driver because of legal technicalities.

    And we wonder why people hate us. But I'm sure management will give the hot shot kudos for "taking another gun off the street."

    A) the key is to blend. Having excessive tint and an expired temp tag is not blending.

    b) Unless in a state where duty to inform, don't inform.

    c) If the above fails, comply. Get your day in court, before a judge. They're much more levelheaded than a hotshot cop.

    Hey, jw34, good to see you. Hope you're doing well and still rich from the bitchcoin. Sounds like a stinky pinch to me, are these younger guys, expecting to change the world? Older, more experienced guys tend to be more realistic and reasonable, in my experience.

    Hey, jw34, good to see you. Hope you're doing well and still rich from the bitchcoin. Sounds like a stinky pinch to me, are these younger guys, expecting to change the world? Older, more experienced guys tend to be more realistic and reasonable, in my experience.

    I may be mistaken but I believe that jw34 is PSP and who knows, we may have even met once. It would only be once though 'cause I haven't met the same one twice (yet).

    And he’s not prohibited from possessing in every case. They may have just pulled his lctf.


    Source. Happened to me goign through a divorce. I never lost possession but was forced to surrender my ltcf until the restraining order was lifted. I had no issues getting my ltcf back after but I did get a talking to by the sheriff deputy after going to pick it up. I explained that I was going through a. Divorce and my ex was doing everything spiteful to hurt me. He said it happens more times than he’d care to admit.

    Yeah, I stop in once or twice a year. Bitchcoin has been non-profitable for me for about a year now, so I'm in limbo til it gets over 32k.
    But yes, this young guy thinks he's "getting guns off the street." I discussed this case with some of my older cohorts and we all agree that 'technically' there's constructive possession, but the properly licensed owner said it was hers and it was hers by ROS, and all us older guys woulda told her to do a better job of keeping it further away from the driver, rather than banging the driver with a Felony 1. (I read the complaint and he has it listed as an F1, but iirc without reading the section, I think it should only be and M1 if prohibited by PFA).

    If this were in philly, they wouldn't have been pulled over.
