Everyone who violates the handful of MVC that the City Councilman thinks is unfair to minority drivers, gets a pass.

Apparently minorities can*t register their car properly, have a bumper on their car, get it inspected on time, affix their license plate correctly, but everyone else can ?!

I will even concede the violation of items hanging from the mirror and maybe a burned out taillight, but c*mon man.

IMO the stop on the expired tag was good. The window tint on a car from Florida is BS. The gun in possession of a legal LTCF holder from another state, honored in Pa.is lawful. The gun charge is BS and again IMO BS and this is total abuse of power. PFA or not, he was not in possession of the firearm if a legal LTCF holder was in the car.

We could what if this situation to death, but facts are facts as presented. The young cop is apparently overzealous trying to make a name for himself. I feel the stop is good, the expired tag charge should have been a ticket. The window tint is legal in Florida so no ticket should have been issued. The gun charge is so far out of line that the officer might be due for a write up and unpaid vacation.

I am still trying to wrap my head around the charge while a legal LTCF holder was in the vehicle. Just can't get myself to that point of a charge!

Just heard about a sketchy arrest I don't like.

    Facts:
Hot shot cop pulls car over for window tint and expired FLA temp tag.
Male driver/vehicle owner is temporarily prohibited from possessing due to PFA which expires next month. Female front seat passenger has valid FLA LTCF. Female front seat passenger advises her pistol is in the center console. ROS check confirms it's her gun. Hot shot arrests male driver for possession by prohibited person.

Yea, she shouldn't have said anything when cop asked if there were any weapons in the car. But IMO, this guy is prohibited for the next 29 days because a judge believed a crazy ex, not because he's got a criminal record. Not my call, but if I were the supervisor at the scene, I would've told the passenger to keep the gun on her person and out of reach from the driver because of legal technicalities.

And we wonder why people hate us. But I'm sure management will give the hot shot kudos for "taking another gun off the street."
Had a case where a PSP trooper cited a woman for driving the family car with her husband's licensed gun in it. Clear exemption in the statutes for this exact situation.
By the time of the Prelim, that trooper was no longer with the PSP. The PSP wanted a continuance so they could substitute another trooper, I got it dismissed instead, I asked for it to be "without prejudice" as a fig leaf; that way the PSP didn't "lose", but nobody there was going to re-file it, either.

I like to think the trooper's departure from service had something to do with his failure to grasp the basics of statutory law.

Source. Happened to me goign through a divorce. I never lost possession but was forced to surrender my ltcf until the restraining order was lifted. I had no issues getting my ltcf back after but I did get a talking to by the sheriff deputy after going to pick it up. I explained that I was going through a. Divorce and my ex was doing everything spiteful to hurt me. He said it happens more times than he*d care to admit.
It's nice for you that it happened that way, but there is ZERO legal basis for the sheriff handling it that way. Strictly following the law, you should have been revoked, and you would have had the right to reapply in one year.

I don't like it, but I'd prefer the law be changed rather than sheriffs decide they can do whatever they want because they have the shiny star. There's too damn much of that, all over the state.
