Re: Possession by prohibited person... (almost)
Everyone who violates the handful of MVC that the City Councilman thinks is unfair to minority drivers, gets a pass.
Apparently minorities can*t register their car properly, have a bumper on their car, get it inspected on time, affix their license plate correctly, but everyone else can ?!
I will even concede the violation of items hanging from the mirror and maybe a burned out taillight, but c*mon man.

Re: Possession by prohibited person... (almost)
IMO the stop on the expired tag was good. The window tint on a car from Florida is BS. The gun in possession of a legal LTCF holder from another state, honored in Pa.is lawful. The gun charge is BS and again IMO BS and this is total abuse of power. PFA or not, he was not in possession of the firearm if a legal LTCF holder was in the car.
We could what if this situation to death, but facts are facts as presented. The young cop is apparently overzealous trying to make a name for himself. I feel the stop is good, the expired tag charge should have been a ticket. The window tint is legal in Florida so no ticket should have been issued. The gun charge is so far out of line that the officer might be due for a write up and unpaid vacation.
I am still trying to wrap my head around the charge while a legal LTCF holder was in the vehicle. Just can't get myself to that point of a charge!Aggies Coach Really ??? Take off the tin foil bro.

Re: Possession by prohibited person... (almost)
Had a case where a PSP trooper cited a woman for driving the family car with her husband's licensed gun in it. Clear exemption in the statutes for this exact situation.
By the time of the Prelim, that trooper was no longer with the PSP. The PSP wanted a continuance so they could substitute another trooper, I got it dismissed instead, I asked for it to be "without prejudice" as a fig leaf; that way the PSP didn't "lose", but nobody there was going to re-file it, either.
I like to think the trooper's departure from service had something to do with his failure to grasp the basics of statutory law.Attorney Phil Kline, AKA gunlawyer001@gmail.com

It's nice for you that it happened that way, but there is ZERO legal basis for the sheriff handling it that way. Strictly following the law, you should have been revoked, and you would have had the right to reapply in one year.
I don't like it, but I'd prefer the law be changed rather than sheriffs decide they can do whatever they want because they have the shiny star. There's too damn much of that, all over the state.Get your "Guns Save Lives" stickers today! PM for more info.
