    Default SBRing an incomplete lower?

    How do you do a form 1 for a lower that you don't have a complete upper for? Guess? I want to get another 9mm lower and I planned on making a "pistol" with it but not anymore. I'd either put a 10" FM9 side charging upper on it or a 5" R&D Precision PW9 upper.

    This is how I did it. I was actually 2 inches off because I changed my mind from a 10.3" to 12.5"

    We reached out to the ATF to get an answer to this question. The National Firearms Act Division recommends that you use an estimate for the overall length of the SBR. You can take the measurement of your barrel and add it the length of your lower with your stock and get pretty close to what the SBR overall length would be when it is fully assembled, a.k.a manufactured. Note: The overall length of your SBR is with the stock fully extended and any removable muzzle devices removed.

    Once you receive your tax stamp back from the ATF, you can then assemble and manufacture your SBR. After you have completed that you can then measure the true overall length of the SBR. If this measurement of your SBR is different than your estimate that you wrote on your ATF Form 1 application, you will need to submit a change of length letter to the ATF. They will then send back to you an approval letter that you will need to keep with the approved tax stamp.

    Yup, don't sweat it, take your best guess, then address it later if needed.

    So you can't change uppers (different lengths) once you get your stamp?

    Yes, you can. Some have said that you should keep an upper with the originally filed length barrel, which is probably a good idea.

    when you form 1 you can just attach a sheet listing every known barrel length to man as the barrel length you may be utilizing at any given time. I think there is something in the form's notes that explains how to list multiple barrel lengths.

    This is actually incorrect.

    You are listing on your form 1 what you are "making", the first configuration. They will decline your form 1 if you list more than 1 caliber, also.
    You don't need to inform the BATF unless it is a permanent change.
    You can put any upper on that you want without notifying anyone.
    There is no need to keep the original upper.

    The issue that pops up is if you go to sell it, & it doesn't match the orig. configuration, they will deny it.
    Before you sell it you need to let them know it's current configuration.

    The laws/rules were made for SBRs before modular firearms came along.
