Expired Carry Permit
What is the LAW for when a Carry Permit expires in Lackawanna County? Can I still conceal carry??? I filed the paperwork a couple weeks ago and received a call to come in and get my new permit with $20 cash in January.

To renew your permit, you need to follow several steps:
There is a 120-day window within which you can renew a concealed carry permit. If you want to submit in advance, you can do so up to 60 days before your current license expires. Once your permit is considered expired, you have another 60 days to renew. After the 60-day period, you have to resubmit as a new applicant. Depending on how much you*re willing to spend and how you plan on carrying your license, you have two options for a physical copy. You can opt for the more expensive hard plastic card * similar to your state driver*s license * with no photo or the less expensive laminated paper version with your photo. For the second version, you*ll need to submit two official passport photos.

None of the above has any basis in the law.
Legally, you can renew at any time. Some sheriffs may resist accepting applications if there is a large amount of time until the expiration, but nothing in the law prevents early application. Second, while the application still contains a checkbox for "Renewal", the process is exactly the same, and whether you are 60 days early, or allow it to lapse for several years. There are no "shortcuts" for timely renewals.
Regardless of the type of license, statute mandates a fee of $20. While "optional" better quality licenses (at additional cost) *might* pass legal challenge, statute requires that ALL issued LTCFs contain a photo of the licensee, so any sheriff offering a version without a photo is violating the law.Last edited by gnbrotz; December 29th, 2022 at 08:18 AM.

Yes and no. The law allows an exception for anyone whose license has been expired for six months or less, so long as they are still legally qualified to be licensed. See 6106(b)(12)
Lots of people call this a "grace period", but given that there is now case law basically saying that all "exceptions" can be treated as an "affirmative defense" instead, depending on the geographical location, and prevailing attitude of LE and the DA, you could possible be charged and forced to raise the defense, rather than having an officer both know of the exception in the first place, and allow you to depart from any encounter after accepting a newly expired license as still meeting the legal requirement.Get your "Guns Save Lives" stickers today! Here's the exact wording of the law
(12) A person who has a lawfully issued license to carry a firearm pursuant to section 6109 (relating to licenses) and that said license expired within six months prior to the date of arrest and that the individual is otherwise eligible for renewal of the license.
B are the exemptions
as you see, it says "prior to the date of arrest". So as discussed, it's a defense that could be raised in court.
