Insofar as PA and Feds are concerned, non-NFA firearms received by an heir from an estate distribution DO NOT require the use of an FFL - even interstate estates. You would need to further check whether MD has any restrictions.

The MD part was the bigger part of the question

Would I legally have to give a crap what MD thought about the matter? As I understand it there are rules about bringing guns into a state, not rules about taking guns out of a state.

Plus if that gun never went back into MD, what could they do?

Hypothetically speaking, or course. My mom is still very much alive.
