That is correct BUT does not make it legal.
They don't ask if you've been convicted, they ask if you use. The question on the form is "Are you an unlawful user of (or addicted to) Marijuana {etc}". It goes on to specifically note that MaryJane is unlawful at the federal level.
So expunged convictions make it far less likely you'll be caught lying on the form, but you're still lying on the form if you smoke pot and say "no". THAT is what they bust you on - the lie.
But so long as we're playing letter of the law... What about this? It says 'are you?' not 'were you' or 'will you be'... So one could argue this as "I didn't currently possess any MJ and hadn't smoked it for a week prior to answering. I did not possess any MJ and did not smoke it for a week after answering. Therefore at the time I answered I was neither a user nor addicted to it and could honestly answer 'no' without lying." What happened outside that window... happened outside that window. Mind you I would NOT want to defend myself on that basis in court... just a thought-experiment.
Personally I'm of the opinion it should NOT be illegal at the federal level. If it's gonna be legal or not, that should be at most a state issue. So the de-facto situation we have (it's legal or not state by state) is the correct one except for that pesky federal law.
Then again, I think the vast bulk of Federal law ostensibly enabled by the 'commerce clause' (which would include MJ prohibitions per Gonzales v. Raich, e.g.) violates the 10th.DGAF

The other question is, is it even illegal to "use" drugs, or just to possess drugs?
Besides charges for being under the influence in public or in a vehicle,.what would be the charge for being under the influence while sitting in your own home?
Does anyone actually know of a charge for "using" drugs?The Hostler

I'd love to try and see if it would work for my 2 stokes residuals. Left arm from the elbow to fingertips feels asleep (pins and needles) and nasty burning sensation, same left leg from below the knee to toes and also the feeling like my left sock is rolled up under my foot. Those sensations are 24/7. probably won't help with aphasia but that I can deal with.
I would sure love to be able to try an alternative but our government says I can take a highly addictive opioid but not MJ. THC does have an addictive element to it and you do build a tolerance.

It's like anything else with the govt - it's all about CONTROL OF THE POPULACE.
Federal govt says you can't use MJ.
Because if you were using MJ, then you would be using MJ.
It doesn't want you using MJ, because if you did, then you would be using MJ.
The reason why you can't use MJ is because the govt says you can't use MJ.
Got it?
