Default Bump Stocks Not Machine Guns, Military Court rules

By the Single Function of the Trigger and Automatically found to be unconstitutionally ambiguous. Citing Chevron Deference.

They also cited: Rule of lenity "The instinctive distaste for men languishing in Prison, unless the lawmaker as clearly said that they should. Here we express that same distaste. "

They went on to conclude that Bump Stocks do not fall under the Definition of Machine Gun.

So, if someone hypothetically still has one, are they good to use yet or is it still a decade in the pokey over plastic?

Well, some random post headline on an internet forum suggests that you're good to go, so that's what I would go with.
    Should be a valid defense!

Well, I don't mean you - I mean someone who hypothetically has one!

I am not an attorney, nor did I watch the video. I tried - I really did, but I could not remain interested enough to stick with it.

The 64 million dollar question is, does the military court, over ride the A.T.F.? I would like to say yes, however I doubt it. Why yes? Because I like their answer to the problem. Bet your bottom dollar that the ATF will come out with a new ruling clarifying, their stance on the matter. Hell they may even try an prosecute the guy themselves, outside of military court.

I doubt anyone gets 10yr on the charge. Wasn't there just a felon caught with drugs 4 unregistered silencers and 2 illegal machineguns and he got 30months... I guess this helps us as being favorable case law to bolster that whatever circuit Court said bumpstocks aren't machine guns.
