    Default Am I allowed to gift my 26 year old stepson a pistol and rifle?

    I'm 59, been married to my step son's mother for over 20 years, resident of PA my entire life(currently disgusted with the state except for my Senator Mastriano- great patriot!!).

    I have my cc permit.
    I would like to gift my step son a 22 pistol and rifle.
    Can I legally do this?
    He has his fathers last name.

    He is not a felon, he is a welder.

    My opinion is I can, but I want to hear from some others.

    Technically I believe you would give it to your wife who would then give it to her son.

    Handgun no.
    Long gun yes.
    Assuming he is a Pa resident.
    You stepson is not your son. If you adopted him then I believe the answer would be yes.

    As stated above, give your wife the handgun. She gives it to her son at a time of her choosing.

    Couldn't he gift it to him through an FFL and fill out the paperwork?

    He should double check that. I was able to gift a car to my step-daughter by producing a marriage license to the state.

    What does that have to do with firearm law?

    Private transfers of handguns among pa residents that are not prohibited is limited to parent to child, grandparent to grandchild, and spouses.

    If the stepson is a non-prohibited PA resident, he can sell the long gun to him for $.01. The handgun is a different story, IANAL.

    Ummm... WHY would he sell it for a penny when he can give it to him?
    There's no transfer required for long guns between two PA residents who are not prohibited persons. The transfer isn't "money based".

    Money changing hands has nothing to do with any of it. No need for any of that silly "I sold him my house for a dollar" nonsense.


    The only part that could be an issue is the pistol.
