Almost half of states do not rely on their own systems, and the ones that do typically lean towards a general anti-gun attitude. Their state systems allows them to identify, flag and deny for things that would not be an issue for most states and the NICS process. The states with more gun-friendly attitudes rely on NICS and take advantage of the "Brady alternative." If undue hardship during the process were the norm, it doesn't make sense that states like AK, AZ, KY, MT, NE, NV, SD, TX, UT, and WV would continue to tolerate it.
This is true if you are looking backwards. There is almost no chance in the current political environment for those states to enact their own system. I do not like how the trend is going with the fed overstepping and for now PA owns the process - for good or for bad. Once we relinquish that control, we will never get it back. If you are denied, the appeal process is state run. I can’t imagine how screwed you would be if you had to rely on a federal process to restore your rights given the whimsical and potentially fluid nature of the fed court system. I may be wrong, but at least we have options.

PICS takes 2-4 weeks to resolve an improper denial.

NICS = 3-12 months, sometimes more.

Going to NICS is a bad choice.

If your problem is the surcharge for PICS, then eliminate that in law by moving cost of operations to the General Fund.

Just got the almost weekly email from NICS:

    Good Morning,

The NICS is out of service. There is NOT an estimated time for return to service. Our System Administrators are working diligently to have NICS back in service as soon as possible. We will send a notice of return to service as soon as we are made aware of the update.

We are very sorry for any inconvenience this may cause.
