    Not necessarily. You can pay for a one time consult fee and explain why you might need an attorney, as a just in case. The attorney should advise on the best course of action, and if he would be willing to be take your call at 1 am.

    According to a cop friend, if you ask for an attorney they will give you an opportunity to call your attorney, from jail.

    No play on words intended. If you are being questioned by the po leece and you say that you want a lawyer before you answer any more questions, they cannot ask you any more questions unless/until a lawyer of some sort is by your side. If they tell you you need to produce your own lawyer they either have to let you go or charge you and lock you up until such time as you get representation. I do not know how it plays out if you just refuse to get one and they proceed in court.

    The police can*t and SHOULDN*T arrest you simply for asking for a lawyer. If they have enough to arrest you, and decide to question you first, then they are looking for you to incriminate yourself further or even confess to make their life easier. You asking for a lawyer only means that they can*t go fishing anymore. If they already have enough evidence to arrest you they will. If they don*t, they will let you go or hopefully your lawyer will get it thrown out at you preliminary hearing for bail.

    You can*t control what they are going to do, but make them earn their paycheck. Don*t give them anything free.

    It*s like searching your house. If you let them in then anything and everything is fair game. So you make them get a warrant. It gives you some chances in court to get the evdence thrown out.
