A conviction is far from certain.
The trial will be determined by mob rule. Kyle will fry.

Perception is reality. Juries are finders of facts. The facts they find are the products of two salespeople aka attorneys. There are reasons some attorneys are winners more often than others. They are top salespersons.

I've seen juries reject attempted murder but find for aggravated assault in a case of several stabbings to the victim's back. I've seen not guilty of receiving stolen property but guilty of burglary.

I'm afraid Kyle's going there may set the stage of vigilantism. Not a good position to be in.
There are two kinds of guns. Those I have acquired, and those I hope to.

Question for Phil. If you were his lawyer, would you have a jury trial or bench trial?

That's true. I was thinking with all the woke people out there nowadays, it may be difficult to find one juror who decides on the facts of the case.

Someone who happens to be armed get violently attacked.

That person shoots the attackers back.

    Open and shut.

In my (mostly pointless) conversations about this with the Democrats I encounter day-to-day, the angle I've gotten the most traction with is to compare him to the "roof Koreans". Unlike them, he did shoot back. Rittenhouse's story also happens to be an excellent example of why you *do*, in fact, need an AR sometimes- Kyle probably wishes he had a thirty thousand round magazine that night.

Rittenhouse Attorney Wants to Show Victim Was Sex Offender
[prohibited person wanting to take the rifle]
    https://www.newsmax.com/newsfront/po...06/id/1027673/
    Tuesday, 06 July 2021

Kyle Rittenhouse's attorney wants a judge to allow him to argue that one of the men his client fatally shot during a Wisconsin protest was a sex offender, saying it supports a defense theory that he attacked Rittenhouse and intended to take his gun because he couldn't legally possess one.

Mark Richards maintained in court filings Thursday that Joseph Rosenbaum was convicted of having sex with a minor in Arizona in 2002 and was prohibited from possessing firearms. Rosenbaum started the altercation with Rittenhouse in hopes of making off with his assault-style rifle, which only bolsters Rittenhouse’s self-defense argument, Richards wrote.

Kimberley Motley, an attorney representing Rosenbaum's estate, said Tuesday morning that she hadn't read the motions yet and had no immediate comment.

Richards also filed a motion to dismiss a charge that Rittenhouse couldn't possess a gun because he was too young under Wisconsin law, arguing that statutes prohibit minors from possessing short-barreled shotguns and rifles, and Rittenhouse's assault-style rifle doesn't meet that definition.

Rittenhouse, who is white, traveled to Kenosha from his home in Antioch, Illinois, on Aug. 25 to answer a call from local militia to protect businesses from protesters. The demonstrations began after a white Kenosha police officer shot Jacob Blake, who is Black, during a domestic disturbance, leaving Blake paralyzed from the waist down.

The protests turned chaotic that night. According to prosecutors, Rittenhouse opened fire on Rosenbaum, Anthony Huber and Gaige Grosskreutz. He killed Rosenbaum and Huber. Grosskreutz was hit but survived.

Rittenhouse was 17 years old at the time. Now 18, he maintains he fired in self-defense but prosecutors have charged him with a litany of counts, including reckless homicide, recklessly endangering safety, attempted first-degree intentional homicide and being a minor in possession of a dangerous weapon.

Black Lives Matter supports have painted him as a trigger-happy white supremacist. Conservatives have made him into a symbol for gun rights, generating $2 million for his bail. His trial is scheduled to begin Nov. 1.

Prosecutors filed motions last week asking a judge to allow a video from July 2020 which they said shows Rittenhouse striking a teenage girl in the back on Kenosha's waterfront. They also want to argue that Rittenhouse is affiliated with the Proud Boys, a far-right extremist group.

Photos taken in January show Rittenhouse drinking in a Mount Pleasant bar and gesturing with what appeared to be a white power symbol. Prosecutors said in their motions they have learned the people Rittenhouse was with included the leader of the Proud Boys' Wisconsin chapter and several of its high-ranking members.

Richards filed another motion on Thursday arguing evidence related to the altercation between Rittenhouse and the teenage girl is irrelevant.

He also argued that there's no indication Rittenhouse knew any of the Proud Boys before that night in the bar or that he has associated with the group. What's more, nothing supports the argument that race was a factor in the shootings, Richards said.

Huber and Grosskreutz were part of a "mob” that was chasing Rittenhouse. Huber hit Rittenhouse with a skateboard and tried to grab his gun, and Grosskreutz pointed a pistol at him, Richards wrote.

Kenosha County Circuit Judge Bruce Schroeder has scheduled a hearing on the motions for Sept. 17.

Judge: Prosecutors Can't Show Rittenhouse Link to Proud Boys
    Friday, 17 September 2021 06:16 PM
    https://www.newsmax.com/newsfront/ke...17/id/1036940/

A judge ruled Friday that prosecutors can't argue that a man who shot three people during a protest against police brutality in Wisconsin is affiliated with the Proud Boys or that he beat up a woman months before the shootings, bolstering his position as he prepares for a politically charged trial.

Kyle Rittenhouse is set to stand trial beginning Nov. 1 on multiple counts, including homicide. The 18-year-old argues he opened fire in self-defense after the men attacked him. Prosecutors signaled that they plan to show infrared video from an FBI surveillance plane that proves Rittenhouse chased down the first man he shot.

Kenosha was in the throes of several nights of chaotic demonstrations after a white police officer shot Jacob Blake, a Black man who was paralyzed from the waist down. Rittenhouse traveled from his home in Antioch, Illinois, about 20 miles (32 kilometers) to Kenosha on Aug. 25, 2020, in response to a call on social media to protect businesses there.

Rittenhouse shot Joseph Rosenbaum, Anthony Huber and Gaige Grosskreutz with an AR-style rifle, killing Rosenbaum and Huber and wounding Grosskreutz. Conservatives across the country have rallied around Rittenhouse, raising $2 million to cover his bail. Black Lives Matter supporters have painted him as a trigger-happy racist.

During a hearing Friday on several motions, Assistant District Attorney Thomas Binger asked to argue at trial that Rittenhouse subscribes to the Proud Boys' white supremacist philosophies and violent tactics. Binger pointed out that Rittenhouse was seen at a bar with members of the white nationalist group's Wisconsin chapter in January and traveled to Miami days later that to meet the group's national president.

Binger also asked the judge to allow evidence that Rittenhouse attacked a woman in June 2020 as she was fighting his sister. He also wants to show jurors video from 15 days before the shootings in which Rittenhouse said he would like to shoot some men he thought were shoplifting from a pharmacy.

Binger said Rittenhouse's affiliation with the Proud Boys, the fight and the video show Rittenhouse's propensity toward violence. He described Rittenhouse as a “chaos tourist” and “teenage vigilante” who came to Kenosha looking for trouble.

Rittenhouse attorney Corey Chirafisi countered that none of the events are relevant to the shootings. Nothing shows Rittenhouse was connected to the Proud Boys on the night of the protest or that the shootings were racially motivated, Chirafisi said, pointing out that Rittenhouse and all of the men he shot were white.

Kenosha County Circuit Judge Bruce Schroeder agreed with the defense about the June fight and interactions Rittenhouse has had with the Proud Boys. He deferred a decision on the pharmacy video but said he was inclined to exclude it.

It was during discussion about that video that Binger said prosecutors have infrared surveillance footage of Rittenhouse chasing Rosenbaum, who was the first person Rittenhouse shot.

Rittenhouse attorney Mark Richards maintained it was Rosenbaum who started chasing Rittenhouse, yelling out, “Kill him!” He said Rosenbaum cornered Rittenhouse in front of a row of cars in a parking lot and threw a bag at him before trying to grab Rittenhouse’s gun.

Binger said the surveillance footage shows Rittenhouse chasing Rosenbaum with a fire extinguisher before Rosenbaum turned to confront him. Binger said Rosenbaum was probably trying to push the barrel of Rittenhouse’s rifle away.

After Rittenhouse shot Rosenbaum, people in the streets began chasing him. Video from the night of the protests shows Rittenhouse shot Huber after Huber hit him with a skateboard and tried to grab his gun. Grosskreutz then approached Rittenhouse with a gun and Rittenhouse shot him.

Schroeder denied a defense request to argue that Rosenbaum was trying to steal Rittenhouse’s rifle because Rosenbaum was a sex offender and couldn’t legally possess a firearm.

He delayed ruling on defense requests to dismiss a charge that Rittenhouse possessed his gun illegally because he was a minor and to allow testimony from an expert on police use-of-force. He set another hearing for Oct. 5.
