"Oh, sh**!" Smith yells. "I'm sorry!"

"I told you I'd kill you. I told your dumb ass I'd kill you," the woman tells him. "I'm sorry!" Smith yells as she fires at him once more.

"You got me for real," Smith is heard saying before pleading for his life. "Baby, I'm sorry," he says. "I'm sorry… I don't want to die!"

That's when the officer calls out for someone to call 911.

That video is probably a good argument for a lot of things. I apologize for side tracking from Kyle's story. My point was that the death of the bad guy doesn't prevent the law suits.
