National Foundation for Gun Rights raises $50K to 'support' Kenosha shooting suspect Kyle Rittenhouse

A conservative gun rights group has raised $50,000 for the Illinois teenager charged with shooting three people, two fatally, during protests last month in Kenosha, Wisconsin.

The conservative National Foundation for Gun Rights, based in Loveland, Colorado, announced Thursday it has sent $50,000 to Kyle Rittenhouse for "defending himself and business owners" amid protests following the police shooting of Jacob Blake.

"I spoke with Kyle's mother this morning to let her know NFGR received over a thousand donations amounting to over $50,000 from folks who support her son," NFGR Executive Director Dudley Brown said in a news release.

According to the news release, Rittenhouse's mother responded: "No words can describe what we're going through. Thank you so much — and I know Kyle and the rest of the family would say thank you too."

The gun lobby donation came after GoFundMe pulled down fundraisers intended to support Rittenhouse and refunded all donations, The Washington Times reported last month.

John Pierce, the lead attorney representing Rittenhouse, resigned his position with a Texas defense fund expected to help the 17-year-old because of a troubled financial history. Pierce and his firm have been involved in a series of financial entanglements, failing to pay nearly $70 million to two separate funders.

Pierce said he resigned from the #FightBack Foundation, which he co-founded, to avoid any "appearance of conflict."

Rittenhouse of Antioch, Illinois, is facing six charges, including one count of first-degree intentional homicide. He is being charged as an adult in Wisconsin and would face life in prison if convicted of the most serious charge.

The other charges include first-degree reckless homicide, attempted first-degree intentional homicide, two counts of first-degree recklessly endangering safety and one count of possession of a dangerous weapon by a person under 18.

Video footage shows Rittenhouse, who is white, using an AR-15-style rifle. After the shootings, footage shows him raising his hands in an apparent surrender, but police drove past him.

Rittenhouse drove from his home in Illinois to the protests in Wisconsin to defend property from unrest, he told reporters. Protests erupted on Aug. 23 after police shot Blake, a Black man, in front of his children. Blake is now paralyzed.

Mom, four experts to testify at Kyle Rittenhouse extradition hearing for Kenosha killings

    Wed, October 28, 2020, 7:52 AM PDT
MILWAUKEE * Kyle Rittenhouse's lawyers expect to call his mother and four experts to testify at a hearing Friday on Wisconsin's efforts to extradite him to face homicide charges in Kenosha.

Rittenhouse, 17, shot and killed two people and wounded a third during civil unrest in Kenosha on Aug. 25 in the wake of a police officer shooting and paralyzing Jacob Blake two days earlier. Though Rittenhouse walked toward police with his hands up, they ignored him; he later surrendered to police at his home in Antioch, Illinois. His mother, Wendy Rittenhouse, will testify about the circumstances of his arrest, according to court records.

His defense team says Rittenhouse acted in clear self-defense and have criticized the complaint filed against him just two days later as a political prosecution. The lawyers announced from the start that Rittenhouse would challenge his extradition to Wisconsin.

Prosecutors charged Kyle Rittenhouse, 17, left, from Illinois, in the fatal shooting of two protesters and the wounding of a third during a night of unrest Aug. 25 in Kenosha, Wis., after the police shooting of Jacob Blake.

One of the experts listed by the defense is Tim Gravette, a prison safety consultant who will discuss "the danger of sending a juvenile to be jailed as an adult in Wisconsin."

Since his arrest, Rittenhouse has been held at a Lake County, Illinois, juvenile detention center.

Also listed as an expert witness for the defense is Andrew Branca, a Denver lawyer who specializes in self-defense cases, instruction and speaking on the topic. His website's tag line reads, "Carry A Gun So You're Hard To Kill, Know The Law So You're Hard To Convict."

Two former homicide detectives are expected to discuss "the apparent lack of investigation prior to the filing of the criminal complaint." One of them is retired Milwaukee Police Lt. Steve Spingola, now a regular on the Oxygen network true-crime TV show "Cold Justice."

Lake County, Illinois, prosecutors indicate in court pleadings that they do not intend to present any witnesses. They point out that under extradition law, an Illinois judge is not in position to question the sufficiency of Wisconsin charge after a Wisconsin judge has found probable cause for Rittenhouse's arrest.

Assistant State's Attorney Stephen Scheller noted in his written response that Rittenhouse "used more than half of his petition to insert irrelevant and inflammatory 'facts' which are solely meant to sway sympathy and public opinion through the media in favor of the defendant and that have no place" in an extradition hearing.

Extradition between states is usually a routine matter. When a defendant does challenge his transfer to a charging state, it usually involves attacks on technical, procedural errors or a claim that the wanted subject is insufficiently identified. Governors from Wisconsin and Illinois have issued all the required warrants.

Rittenhouse's lawyers are trying to argue that, because of his self-defense claim, the charges against him are so lacking that Illinois would, in effect, be violating Rittenhouse's civil rights if it agreed to release him to Wisconsin authorities.

In contrast to a pair of prior hearings, Friday's will not be livestreamed on YouTube, a court spokeswoman said, and in-person attendance in the courtroom and an overflow room to view it on closed-circuit TV will be limited because of coronavirus precautions.

Judge grants request to extradite Kyle Rittenhouse to face charges in Wisconsin
by Haley Victory Smith, Breaking News Reporter - October 30, 2020 05:18 PM

An Illinois judge has granted a request to extradite Kyle Rittenhouse to Wisconsin, where he will face homicide charges.

The 17-year-old is accused of fatally shooting two protesters and wounding another in Kenosha, Wisconsin, during a late August riot following the police shooting of Jacob Blake. His lawyers have argued he was acting in self-defense.

Judge Paul Novak determined after a Friday hearing to grant the extradition request, which Rittenhouse's team opposed.

Rittenhouse faces six criminal charges, including two counts of first-degree intentional homicide.

After the shootings, the teenager returned to Illinois, his home state, before he was arrested and held there.

Rittenhouse's legal team argued that extraditing its client would be a violation of his constitutional rights and that it would be like turning him "over to the mob."

A lawyer for Rittenhouse tweeted earlier that his team would appeal a decision by Novak should he rule unfavorably to the group, according to the Milwaukee Sentinel Journal.

Illinois judge OKs extradition of Rittenhouse to Wisconsin

WAUKEGAN, Ill. (AP) — An Illinois judge on Friday ordered a 17-year-old accused of killing two demonstrators in Kenosha, Wisconsin, to be extradited across the border to stand trial on homicide charges, saying it wasn’t his role to vet a case brought by Wisconsin protestors and approved by a Wisconsin judge.

In his six-page written ruling rejecting Kyle Rittenhouse’s bid to remain in Illinois, Judge Paul Novak noted that defense attorneys had characterized the Wisconsin charges as politically motivated.

“This Illinois court shall not examine any potential political impact a Wisconsin District Attorney potentially considered in his charging decision,” Novak wrote. He added that, according to Illinois law, it is not for an Illinois judge to “reevaluate probable cause determined by a Wisconsin court.”

The ruling came several hours after a hearing on the matter. It was not immediately clear how soon Rittenhouse might be transferred to Wisconsin or whether he might appeal.

The shootings happened Aug. 25, two days after a white police officer trying to arrest Jacob Blake shot the 29-year-old Black man seven times in the back, paralyzing him from the waist down. Video of the police shooting sparked outrage and helped spur on the protests.

Rittenhouse’s case has become a rallying point for some conservatives who see him as a patriot who was exercising his right to bear arms during unrest. Others portray him as a domestic terrorist who incited protesters by showing up wielding a rifle.

At Friday’s hearing, Rittenhouse’s lawyer said he’d had a change of heart since notifying the court that he planned to call witnesses, including Rittenhouse’s mother. Instead, John Pierce focused on what he called “fatal defects” in extradition papers.

A local prosecutor said the law is unambiguous in requiring Rittenhouse’s extradition.

“You can imagine the chaos if someone can commit a crime and step over the (state borderline) and get sanctuary,” Lake County Assistant State’s Attorney Stephen Scheller told Novak.

Rittenhouse sat at a defense table wearing a dress shirt and tie — mask across his face. At least once, he turned to look at his mother, Wendy Rittenhouse, on a spectactors’ bench. Later, as officers led him from the hearing room, she began to cry.

In his ruling, Novak said an extradition to another state can be halted only under several clear conditions, including if the extradition papers aren’t in order, if a suspect hasn’t yet been charged or if the identity of the suspect is in doubt. He said none of that applied.

Without witnesses from either side, the part of Friday’s hearing meant for evidence and testimony lasted less than 30 seconds, when Scheller handed the judge Illinois Gov. J.B. Pritzker’s signed warrant calling for Rittenhouse’s extradition.

Pierce told Novak that Wisconsin authorities were required by law to present charging documents to a magistrate judge and that their failure to do so rendered their extradition request invalid.

Novak dismissed that argument, saying in his ruling that Rittenhouse’s lawyers had offered no evidence that a magistrate judge did not review the charges.

“Even if this court were to find the complaint (was) not made before a magistrate … Rittenhouse’s argument would still fail,” he wrote. The warrant signed by Pritzker, he said, “satisfies all the requirements.”

The most serious charge Rittenhouse faces in Wisconsin is first-degree intentional homicide, which carries a life prison sentence. He is also charged with attempted intentional homicide in the wounding of a third protester, as well as a misdemeanor charge of underage firearm possession. His lawyers have argued he was acting in self-defense.

Rittenhouse and the man he allegedly injured are white, as were the two men who were killed.

A day after the shooting, Rittenhouse surrendered to police in his Illinois hometown of Antioch, some 10 miles (16 kilometers) southwest of Kenosha.

According to prosecutors and court documents, Rittenhouse killed 36-year-old Joseph Rosenbaum, of Kenosha, after Rosenbaum threw a plastic bag at Rittenhouse, missing him, and tried to wrestle his rifle away.

While trying to get away in the immediate aftermath, Rittenhouse was captured on cellphone video saying, “I just killed somebody.” According to a complaint filed by prosecutors, someone in the crowd said, “Beat him up!” and another yelled, “Get him! Get that dude!”

Video shows that Rittenhouse tripped. As he was on the ground, 26-year-old Anthony Huber, of Silver Lake, hit him with a skateboard and tried to take his rifle. Rittenhouse opened fire, killing Huber and wounding Gaige Grosskreutz, of West Allis, who was holding a handgun.

Can*t pardon someone until they are convicted. It will take months to years to get to the end of this. If Trump loses the election he won*t be in office to grant a pardon.
