    Default FOPA Coverage of Mags and Ammo

    What's the case law like for FOPA covering magazines and ammo during interstate travel?

    This of course would only be for the in-between states, not the starting or destination. And I do know it's only a defense, so Officer Sparky in NJ may still jam you up over an 11 round mag.

    I'm not aware of any case law but the law itself does not address either magazines or ammo except to say the gun can't be loaded and ammo stored separately.
    Seems to me once the magazine and ammo are out of the gun, the two of them are treated as separate things and state statues would determine if you are legal or not.

    FOPA covers "firearms" and nothing more.

    It provides guidelines that must be followed for ammunition in order for the "firearm" protection to apply, but provides no protection for ammunition or other "accessories" that may not be legal in every state.

    If you are planning a trip, UPS your Ammo and Mags to your destination. Most hotels will be happy to receive a package for you, especially if it arrives the same day you do. Just don't tell them what it is, or tell them its golf balls.

    With the recent reliability of USPS and other carriers, I'd never risk my mags to them anymore.

    I just completed a FOPA-compliant trip through one of the worst anti-2A states to a friendly one. No issues.

    Just consciously try NOT to be pulled over for speeding on the highway.
