Perp shot in the back is not proof certain that the cop exceeded constraints.

It is possible for a running shooter to send rounds back to where/who s/he is running from, alternately twisting the body to fire the shot. If the pursuing officer being fired upon shoots in defense, and happens to hit as the perp's back is square to him or her, it is still a "good shoot", as the TV cops say.
