It would be especially justified in Brazil, where feral kids will kill you in a second. Brazil isn't really a 1st World nation.

In Philly he'd be charged, but acquitted, if it even got to a jury. PA law doesn't require that you be directly threatened if you are acting to protect another, for example the girl at the cash register with the gun pointed at her. Further, everyone in that store was at risk from the lawless a-hole waving the gun around.

The 2 head shots would increase the chances of being charged, just like a solid home defense shooting using your registered MG would make most DA's want to charge you anyway.
