    I know I'm talking craziness but I believe it's still correct per the law- If a firearm begins life as a rifle, it can not be made into a pistol. So my advice to anyone finishing a 80% is that they first make a pistol (if you get what I'm saying winky winky)

    As long as you aren't prohibited from owning it and have no intention of selling it, yes.
    Regarding the lack of a SN, it's the intention of selling it. You can sell it, but if you build for the purpose of selling it, ATF won't be happy. That said, some/many FFL's won't transfer an unserialized gun.

    I started photographing my stuff before assembly into a pistol and then fully assembled.
    Those are not glamorous shots - they are kept as a "record" just in case.

    And yes, I'm building as pistols first these days for the reason mentioned.

    This applies to virgin "100%" lowers as well - not just 80%.

    Summary:

    An 80% lower can be made into a rifle, pistol or SBR (but for a SBR you have to fill out a BATFE Form 1 and inscribe the manufacturers name(you), city, state and a serial number that you assign to it on the lower receiver)

    A pistol made from a 80% lower can be then made into a rifle and turned back into a pistol.

    A rifle made from a 80% lower CANNOT be made into a pistol without proper documentation (now the question will be - where do you find this documentation - the documentation would be a BATFE Form 1 (see definition 1.c.))

    A 80% lower made into a pistol with a pistol brace can be shouldered and it is not considered a SBR according to the BATFE (at this time, they can change their minds whenever they want to) because shouldering it does not change the physical properties of the firearm.

    A person who made a firearm from a 80% lower can sell it legally. What cannot be done is to finish a 80% lower or make a firearm from a 80% lower with the intention of selling it, making a profit or taking a loss

    Now, if you make a 80% lower into a rifle and a year down the road you decide you want an AR pistol and you buy the pistol brace and the short barrel upper and swap the rifle parts out, who exactly is going to know? Especially if you have other AR's you own. I just wouldn't brag about doing it.

    I agree with EM, take a picture of it as a pistol and then put the picture(s) in storage - just in case. Oh, and make sure you date stamp the pictures somehow, otherwise they are worthless as proof.

    My comments deal with 80% lowers because of the thread, it it also goes the same for manufactured (100%) lowers and other virgin receivers.
