    Default I won my 302 expungement

    Just under a year after this journey began, I finally received the order from the Court of Common Pleas of Delaware County, ordering the expungement of the records of my illegal 302. My age when the order came down was 17 years, 8 months, and 14 days. I've probably set the record for the youngest person to get this kind of relief.

    I hope the Pennsylvania State Police actually expunges the commitment records as they are told. I do not want to get denied when I go out and attempt to purchase my first firearm. I will also be applying for a New Jersey Firearm Purchaser's Identification Card (My parents have a summer residence there, under no circumstance would I ever move to the People's Republic of New Jersey).

    My constitutional rights had been taken away from me without due process. I don't know how 10 (or fewer) minutes in the emergency room with a single doctor and no chance to confront your accusers or present your own evidence constitutes "due process" but to the ATF, it is enough to take away your right to bear arms at the Federal Level under 18 USC § 922 (g)(4) for the rest of your life. I was 14 years, 7 months, and 9 days old when the 302 occurred.

    I will be getting the final bill from my lawyer (Michael P. Gottlieb, Norristown) in the mail soon (he sent it on Monday). I've already spent $2500. Unfortunately, through my research (though I haven't asked my lawyer), there seems to be no way I can sue the doctor who did the original commitment or the hospital it took place at to help recover some of the cost, despite the commitment being ruled to be based upon insufficient evidence under 18 PA CS 6111.1 (g)(2) which is extremely difficult to do since In re Nancy White Vencil. I'm happy I have my rights back though.

    I might be making a YouTube video about the 302 expungement/mental health relief process (If I can get the lawyer who did my 302 expungement on board with it). I often see people (even lawyers!) on online forums giving erroneous advice about it.

    Lessons learned:
    Never take your rights for granted. It only takes a few wrong moves to have them taken away for life.

    Also, the case files were ordered sealed and I saw that my case was removed from the civil court docket website. Phew. No having to explain this to someone running a civil litigation search on me in the future.

    If I ever get pulled over by the Pennsylvania State Police and given a ticket I'll say "I beat you in court once, I'll do it again!"

    Congratulations and good luck to you! It's a shame that you had to go through all of that and spend a lot of money on it too.

    I'll let you all know how much the final bill was when I get it.

    Remember though, a lawyer who offers to do a 302 expungement or restoration of firearm rights for cheap probably doesn't know what the hell he/she is doing.

    Thank you! My grandmother paid for it all, saying "While I don't like guns, your right to own them shouldn't be taken away over a few minutes in the emergency room".

    Now if only ATF could agree.
