    Bill allowing concealed-carry without a permit advances in Ohio House

    COLUMBUS, Ohio — After a one-week detour, a bill that would allow Ohioans to carry a concealed gun without a permit has advanced in the Ohio House.

    A House committee on Wednesday voted mostly along party lines to refer for passage House Bill 178, which would allow anyone 21 and older to carry any concealed deadly weapon as long as they’re not legally barred from owning a gun.

    The bill is now expected to head to a different committee for further review, something that’s unlikely to happen before the legislature breaks for its summer recess.

    Ohio’s existing concealed-carry system, under which one can only conceal handguns, and only after going through a permitting process that involves mandatory training and a background check, has been in place since 2004, signed into law by then-Gov. Bob Taft following a years-long lobbying campaign by the National Rifle Association. That bill was backed by House Speaker Larry Householder, who also leads the House today.

    Before referring HB178 on Wednesday, members of the House Federalism Committee removed language that was added to the bill last week.

    Two Republican committee members — Reps. Kyle Koehler of Springfield and Ryan Smith of Gallia County— had voted with Democrats to amend the bill to save a current provision requiring that gun shops provide buyers with a pamphlet summarizing state gun laws.

    Second Amendment activists pushing the bill have loudly objected to keeping the permit requirement, claiming summarizing Ohio laws could end up killing gun owners, since state law includes a duty to retreat before using deadly force in self-defense. On Wednesday, Koehler compared this to objecting to a speed-limit sign if someone doesn’t like the speed limit.

    But in an about-face, the committee voted Wednesday to remove the pamphlet requirement. It was a mix of a change of heart and a change in committee attendance. Rep. Doug Green of Brown County switched his vote after voting to remove it last week. And Rep. Joe Miller, a Lorain County Democrat who voted to keep the permit requirement last week, wasn’t there Wednesday.

    Rep. Tom Brinkman, a Cincinnati Republican who voted for the bill, said the pamphlets were a cost burden for gun-store owners, especially since Ohio’s gun laws already are available online.

    After losing the amendment fight, Koehler ended up voting for advancing the bill.

    “I’ve always supported this bill. I Just wanted to make it the best as it could possibly be, and I didn’t think gun owners having a pamphlet explaining current law could do any harm,” Koehler said.

    Smith did not, after he failed to convince members to amend the bill to keep a requirement that concealed-weapon carriers notify police officers during a stop that they have a gun.

    Columbus State Rep. Adam Miller, the top Democrat on the committee, said he’s shared his concerns with the bill with Gov. Mike DeWine’s staff. Miller pointed out opponents of the bill include groups representing police and prosecutors. DeWine, a Republican, is a former county prosecutor who has supported gun-safety measures at times during his political career, although he was elected in November with support of prominent gun-rights groups.

    “It’s good to know the governor is weighing this carefully, because I know he is a supporter of Second Amendment Rights. I also know the governor is very much a prosecutor who supports law enforcement and the rule of law,” Miller said.

    Chris Dorr, president of Ohio Gun Owners, an activist group that aggressively backed HB178, called the committee vote “a big victory for gun owners in Ohio.”

    “This is a sign that gun owners in the state are finally organized and mobilized,” he said. “And now we’re just looking forward to the rest of this process.”

    Jill Bowman, a Cincinnati activist with Moms Demand Action for Gun Sense in America, said her group, which pushes for tighter gun laws, will continue lobbying against the bill.

    “I don’t understand how people can’t realize that more people armed are likely to cause more injuries or more shootings,” she said. “I don’t understand that concept. The bill’s just a bad bill.”

    Apparently tomorrow is 2nd Amendment Day in Oklahoma. Their legislature made June 28th 2nd Amendment day in honor of one of the 2nd’s biggest wins of the last decade or so..... McDonald vs the city of Illinois. So be sure to celebrate tomorrow


    Oklahoma Legislature Approves Second Amendment Day

    While state legislatures across the nation are making their constituent’s intents known regarding gun ownership rights, Oklahoma has taken a unique step in designating a Second Amendment Day for the state.

    A bill authored in the House by Steve Vaughn and in the Senate by Frank Simpson ultimately garnered a total of fifteen co-sponsors as it sailed out of committee with a unanimous “do pass” recommendation. It passed by wide margins in both chambers. Governor Mary Fallin signed the bill into law on April 14, 2011.

    An “emergency” provision of the bill places the act into immediate effect, meaning that beginning this year and every June 28 thereafter will be the official Oklahoma Second Amendment Day.

    June 28 was selected, quoting the act, “to commemorate the day the United States Supreme Court , in the case of McDonald v. City of Chicago, Illinois, 130 S.Ct 3020 (2010), declared that through the Fourteenth Amendment to the United States Constitution, the Second Amendment right of individuals to bear arms is fully applicable to the states.” The ruling nullified the long standing ban on handguns in the city of Chicago by ruling such bans unconstitutional.

    Oklahoma is the first state to officially designate a “Second Amendment Day.” Guns and Patriots reported last week on the designation of official state firearms being proposed and passed by state legislatures. It would appear the people, through their state legislatures, are expressing their opinions about the Second Amendment in various ways, including the ones mentioned as well as many other states expanding the right to carry.

    How about Gunners? Should this become a national movement to recognize and commemorate the date, or is this just one more Red State act of defiance?

    Today is the 9 year anniversary of one of the biggest wins for the 2nd in decades. McDonald vs. Illinois. This is a biggie and shows the importance of appointing Supreme Court justices who will read the Constitution for what it says, not what they want it to say. Supposedly the democrats have put together a list of judges that they will use if a Supreme Court nominee comes up (at least Ginsberg). They will not release the names. After listening to the debate last night they will be very progressive judges. McDonald would have gone differently if there was just 1 more progressive judge. The Landscape of the 2nd would be very different today.

    Basically this ruling said that citizens have the right keep guns and that handgun bans violate the the 2nd and 14th amendments. I included an article that has just about anything that a person might want to know about McDonald below for people not familiar with the case or who want to refresh their memories.

    Two years ago, in District of Columbia v. Heller, we held that the Second Amendment protects the right to keep and bear arms for the purpose of self-defense, and we struck down a District of Columbia law that banned the possession of handguns in the home. The city of Chicago (City) and the village of Oak Park, a Chicago suburb, have laws that are similar to the District of Columbia's, but Chicago and Oak Park argue that their laws are constitutional because the Second Amendment has no application to the States. We have previously held that most of the provisions of the Bill of Rights apply with full force to both the Federal Government and the States. Applying the standard that is well established in our case law, we hold that the Second Amendment right is fully applicable to the States.

    Otis McDonald, Adam Orlov, Colleen Lawson, and David Lawson (Chicago petitioners) are Chicago residents who would like to keep handguns in their homes for self-defense but are prohibited from doing so by Chicago's firearms laws. A City ordinance provides that "[n]o person shall ... possess ... any firearm unless such person is the holder of a valid registration certificate for such firearm." The Code then prohibits registration of most handguns, thus effectively banning handgun possession by almost all private citizens who reside in the City....

    Chicago enacted its handgun ban to protect its residents "from the loss of property and injury or death from firearms." The Chicago petitioners and their amici, however, argue that the handgun ban has left them vulnerable to criminals. Chicago Police Department statistics, we are told, reveal that the City's handgun murder rate has actually increased since the ban was enacted and that Chicago residents now face one of the highest murder rates in the country and rates of other violent crimes that exceed the average in comparable cities.

    There is another thread about senators in Oregon walking out over climate change. I stopped reading the thread after the first couple of post so am not sure if this was brought up, but they killed anti 2nd amendment legislation that would have severely harmed the 2nd Amendment in Oregon. It shows some legislators willing to truly fight for the 2nd and appears to me to be a win for the 2nd at least for now.

    A pro-Second Amendment group of Oregon state senators recently stopped an omnibus anti-gun bill in its tracks.

    The 13 senators refused to participate in floor sessions until the bill was withdrawn from consideration. And in mid-May, Senate leadership reached an agreement that the anti-gun legislation would not be moving forward this session.

    Among other things, the package would have allowed gun dealers to refuse service to law-abiding citizens aged 18-20; required firearm storage that would have made guns unavailable for self-defense; allowed local governments to create “gun-free zones” in public buildings, colleges and airports; and increased the fee to apply for a concealed handgun license.

    Anti-gun legislators have already announced they intend to reintroduce a similar version next year or potentially file a ballot initiative in 2020.

    Senators involved in derailing the legislation were Sen. Dallas Heard, District 1; Sen. Herman Baertschiger, District 2; Sen. Fred Girod, District 9; Sen. Jackie Winters, District 10; Sen.     Teen concealed carry, many other laws now in effect

    BOISE, Idaho (AP) — A law lowering from 21 to 18 the age limit for carrying a concealed handgun within city limits in Idaho without a permit or training went into effect Monday.

    The law passed by Idaho lawmakers and signed by Republican Gov. Brad Little aligns gun laws in urban areas with rural areas where those 18 and older can already carry a concealed handgun. About a half dozen other states have similar laws allowing 18-year-olds to carry concealed guns without a permit.

    That’s one of more than 300 new or amended laws passed by Idaho lawmakers earlier this year.

    Backers of the new gun law said the change will protect law-abiding citizens from accidentally breaking the law when they travel across a county and enter city limits.

    Opponents said there’s a big difference between rural Idaho and urban Idaho and not allowing persons age 18 to 20 to carry a concealed handgun in urban areas is reasonable to prevent accidental shootings and shootings resulting from altercations.

    SAN ANTONIO (KTSA News) – Following an incident at a downtown restaurant that drew national attention, a local diner is running a promotion showing support for law enforcement and Concealed Handgun License holders.

    Today through Saturday, August 3, Tip Top Cafe is offering a 30-percent discount to law enforcement personnel in uniform and anyone presenting a CHL.

    Tip Top Cafe’s General manager Cecilio Ojeda wants everybody to know that law enforcement and CHL clientele are always welcome at the landmark diner on Fredericksburg Road.

    The promotion comes after Fogo de Chao Brazilian Steakhouse asked a San Antonio police officer to leave Saturday night because he was carrying a gun. The restaurant chain has since apologized.

    Fogo de Chao has issued a statement saying,”We made a mistake by asking him to leave and sincerely apologize to the officer and to the San Antonio Police Department for this unfortunate lapse in judgment. We are working hard to address and correct the matter, and that includes us apologizing directly to the officer and training our team members on the laws in relation to firearms on business premises. We support, respect and appreciate everything our law enforcement does to keep us safe, every day.”

    I wanted to throw out there that some legislators are defending the 2nd even in the face of the recent media blowback. Two that have been front and center are Dan Crenshaw and Ted Cruz though there are plenty of others. There are members of Congress who really do believe in the 2nd and should get credit for that . (And any support we can give them)

    Reps. Alexandria Ocasio-Cortez, D-N.Y., and Dan Crenshaw, R-Texas, clashed in personal terms Wednesday over calls for universal background checks and other gun control measures in the wake of the mass shooting in Texas that left seven dead and at least 25 injured.

    Ocasio-Cortez went after Crenshaw for a tweet about a Houston-area woman who used a handgun to defend herself when five men tried to rob her.

    “Situations like this story are why we protect the 2nd Amendment,’ Crenshaw tweeted.

    He added: “Side note: With universal background checks, I wouldn’t be able to let my friends borrow my handgun when they travel alone like this. We would make felons out of people just for defending themselves.”

    Ocasio-Cortez quickly replied, asking why he is “lending” people his guns and accusing the Texas lawmaker of giving firearms to people who have “likely abused their spouse or have a violent criminal record.”

    Crenshaw did not take kindly to Ocasio-Cortez’s words – responding by questioning why she thinks his friends are domestic abusers and criminals, and saying that people lend one another guns for self-defense and hunting.

    Crenshaw then took a shot at Ocasio-Cortez’s hometown, saying, “This is America outside NYC.”

    But Ocasio-Cortez didn’t back down. To those defending Crenshaw, she tweeted: "This idea of 'I know the guy, there’s no way he beats his wife' as the way we keep guns out of the hands of abusers is ridiculous. Any person who has been abused, assaulted, etc knows that abusers often present as 'upstanding.'"

    She added, "Domestic abusers can be master manipulators. Plus, domestic abuse is a HUGE indicator for gun violence. That’s why 'vouching for friend' isn’t a substitute for a background check."

    She also said that "if a background check would be a problem, then you shouldn’t ‘lend’ a gun,” while arguing that her state is one of the safest regarding gun violence. "Try to keep up," she tweeted.

    Crenshaw is now the second Texas lawmaker to get into a high-profile Twitter battle since the Odessa shooting.

    On Sunday, Sen. Ted Cruz, R-Texas, took actress Alyssa Milano to task over her faith-based question about where in the Bible does it say that a person has the right to own a firearm.

    Cruz responded, telling the anti-gun activist, it was an "excellent" question, "worth considering [without] the snark of Twitter," before citing a few examples from the Bible.

    "It is of course not the right to a modern-day firearm that is God-give [sic] but rather the right to Life & the right to Liberty. Essential to that right to life is the right to DEFEND your life & your family," the Texas conservative began.

    "The right to self-defense is recognized repeatedly in the Bible," Cruz wrote, for example, "Exodus 22:2: 'If a thief is caught breaking in at night & is struck a fatal blow, the defender is not guilty of bloodshed.' (Note, though, verse 3 says it IS murder if during daylight (ie, not self-defense)."

    He also clashed with Chicago's mayor over the gun violence debate.
