Re: Costco shooting
Interesting. So in Florida, a guy is violently assaulted and shoots and kills his attacker while still on the ground. He's sentenced to prison.
In thise case, the guy is allegedly assaulted (we still haven't seen any surveillance footage) gets up, and then shoots, even though there was no apparent threat.
Can't wait for the police to investigate themselves, and find out that he did everything correct based upon his training and experience.Rules are written in the stone,

DA: No charges for officer in off-duty shooting at CostcoOff-duty LAPD officer acted in self-defense after mentally-ill man attacked him, attorneys saidToday at 2:41 PM

RIVERSIDE, Calif. — A grand jury declined to bring charges against an off-duty Los Angeles police officer who fatally shot a mentally ill man who assaulted him in a Southern California Costco warehouse, Riverside County District Attorney Mike Hestrin said Wednesday.
Officer Salvador Sanchez, a seven-year veteran of the LAPD, opened fire on June 14, fatally shooting Kenneth French and injuring his parents, Russell and Paola French.

Hestrin said the results of the investigation were presented to a grand jury this month and the panel declined to return charges.
"One of the pieces of information that I think was uncontroverted was that the off-duty officer was struck by Kenneth French — struck in the head — and he went down as he was holding his infant child," Hestrin told a news conference. "And it all happened very fast, about less than four seconds from the moment that he (French) struck to the moment that he (Sanchez) fired."
Lawyers for Sanchez have said he acted in self-defense when French attacked him as he was holding his 1½-year-old son during a shopping trip to the warehouse store in Corona. French knocked him to the ground, Sanchez's attorney David Winslow has said, and he briefly lost consciousness.
Believing his life and his son's life were in "immediate danger," Winslow has said, Sanchez fired his handgun. The LAPD is conducting an administrative inquiry into whether Sanchez followed the department's policies.
Dale Galipo, an attorney for the French family, has said Russell and Paola French were trying to explain to the officer that his son had a mental disability when shots rang out. French, 32, of Riverside, had been taken off his medication due to other health complications, which may have affected his behavior that night, Galipo has said.
Galipo has called it an "open-handed push or slap" to the policeman's back.
The family has filed a claim — a precursor to a lawsuit — against Sanchez and the Los Angeles Police Department. A Riverside County judge has issued an order that keeps surveillance footage and cellphone video out of the public eye for one year because of the investigation.

Re: Costco shooting
So we'll be seeing surveillance footage any time now, right? Lemme guess, no cameras in the area were working that day.

Re: Costco shooting
It proves that the DA is corrupt and is letting an officer off for improperly handling a situation that was most likely not threatening....... see I can make shit up with no proof too lol. (that was sarcasm fyi) But really they can't stand behind only police should be able to carry firearms due to training if this video disproves it. They still will but eh California something really needs to be done with that state to correct it's political thinking.

Deadly Costco Shooting In Corona By Off-Duty Cop Ruled Improper
A commission ruled that the off-duty LAPD officer acted outside of department policy when he shot and killed a man at the store last year.

CORONA, CA * The Los Angeles Police Commission Wednesday found that an off-duty LAPD officer acted outside of department policy when he shot a 32-year-old man to death and injured his parents at a Costco in Corona last year.
The victim, Kenneth French, was described by his family as non-verbal and intellectually disabled.
The shooting occurred inside the store at 480 N. McKinley St. on June 14, 2019. Witnesses said they heard an argument in the freezer section of the store, followed by gunfire.
Corona police said the off-duty officer -- later identified as Salvador Sanchez -- was shopping at Costco with his family, holding his child in his arms, when, "without provocation, a male unknown to the officer's family assaulted the officer."
According to the officer's attorney, David Winslow, Sanchez briefly lost consciousness, and when he awoke, he was on the ground and his 18-month-old son was next to him screaming. Winslow said the officer "had no choice but to use deadly force."
The commission voted unanimously Wednesday to adopt Police Chief Michel Moore's recommendation to find that Sanchez, who was named in a lawsuit from the French family, improperly drew his weapon and used lethal force against French in the incident.
The case will now be subject to Moore's discretion, Police Commission officials told City News Service.
"Regardless of the outcome of this next chapter, I express my profound regret for what occurred to the French family and loved ones," Moore said. "The decisions and actions of this officer cannot be justified and are inconsistent with the department's core values, training and expectations of every member of this organization."
Moore said he ordered the proposed disciplinary action "be brought back to his desk at the earliest opportunity," as extensive details of the incident have already been gathered, including the statements from the officer involved.
Police officers have the option of having their discipline cases heard by an all-civilian review board of three members or they can choose two command-level officers and a civilian to hear their case. Moore's disciplinary recommendations, if any, were not immediately available.
Sanchez was placed on leave pending adjudication of the incident.
Moore's report on the incident stated the officer felt as if he'd been "shot" after being struck by French. When Sanchez looked back at French, the officer said it appeared French may have been holding a firearm, although one was not recovered in French's possession.
Moore said Sanchez did not take the time to assess the situation.
Conflicting stories emerged over the circumstances that led to the fatal shooting, with the dead man's relatives calling for the officer's arrest. Several people who called into Wednesday's Police Commission meeting said Sanchez should be fired.
Dale Galipo, an attorney for the French family, has told reporters in various interviews that French -- having recently been taken off his medications due to health reasons -- pushed or shoved the officer in the back in a food-sample line, but he denied that there was any deadly threat to the officer. He also said French's father tried to explain to the officer that his son was intellectually disabled.
The resulting shooting "was a complete overreaction on behalf of this police officer," Galipo told reporters.
French's parents sued the city of Los Angeles and the officer in December. The Los Angeles Superior Court lawsuit alleges battery, negligence, civil rights violations and both intentional and negligent infliction of emotional distress. The complaint seeks unspecified damages.
"If it was anyone but a police officer who went into a Costco and fired 10 shots (and killed somebody), they would've been arrested and charged with murder," Galipo said at the time.
Sanchez is named as a co-defendant in the suit, which states that the gun he used to shoot French was issued to him by the LAPD. In addition, the officer's training in the use of deadly force was "totally inadequate and inappropriate," the suit alleges.
Kevin French, the decedent's younger brother, said Kenneth was "just a loving, caring human being who never hurt anyone."
The Corona Police Department worked with the Riverside County District Attorney's Office in its investigation of the shooting. The LAPD, meanwhile, conducted its own administrative investigation, in conjunction with Corona police, according to the department.
