Re: 2 cited in Tamaqa lying on 4473
Your suggestion would mean that the law has to be changed. There is a big difference between “served more than 6 months in jail”, and “punishable by more than one year in jail”. You can be convicted of a crime punishable by more than one year in jail, but only get probation and a fine. The forms do not require that you have extensive knowledge of any laws. It is a series of questions that require either a yes or no answer. For a firearms purchase it pays to do your research. Do a background check on yourself. I am not squeaky clean but I got transcripts of my cases to see what the final disposition of my cases were. When you exactly what you were convicted of, it’s not difficult to find out what the maximum penalty for that conviction is.

Re: 2 cited in Tamaqa lying on 4473
If one can get their drivers license history and criminal history online, I don't know why PA state police can't have a system in place where one can find out if they are under a firearms disability. They could even charge a fee and make some money on this.
One could run a query on themself if they have a questionable background and find out officially if they are cleared to buy and possess a firearm. The state police will collect their fee and an unintentional crime could be prevented.

Yes, that's why I suggested that it be changed.
Yes, that's why the words are different.
Actually, the 4473 requires that you reach a correct legal conclusion under penalty of criminal prosecution. They don't ask what you did, they ask what the law said about what you did, which is different, and why I suggested that the law ask what you did, as in "was your body in a prison cell for more than 6 months in a row?" people remember that kind of thing, even people with multiple "cases".
Actually, that's not the question, the question is 'what was the maximum permissible sentence AT THE TIME?' Show me where the average citizen can, without "difficulty", find the text of a statute as it stood in 1975, prior to any amendments in the intervening years. I have old books that I spent a lot of money on.
While you're at it, tell me the max sentence for a DUI in 2005. Don't spend more than 5 minutes at it, and don't visit the county seat to do it. And if you get it wrong, let's assume that you'll be arrested and tried for some flavor of perjury.Attorney Phil Kline, AKA gunlawyer001@gmail.com
