    The correct answer is, " I have nothing illegal in my vehicle". And if I am not mistaken once the officer tells you why he has pulled you over that places a limit on the scope of his encounter.

    I have never heard of any case where a cop has been charged with stealing property which he seized under color of law, reported in his paperwork, and kept in departmental custody. Maybe if he seized it, didn't mention it in the report, and took it home, you might get somewhere, if you could prove it.

    You might find some traction in a 1983 civil rights action. But not criminal charges.

    You have a duty to provide proof of licensure upon lawful demand, if you're carrying concealed or in a vehicle. I don't think the courts have defined "lawful demand".

    Generally, I don't think you have any legal requirement to say a word in most encounters. Sometimes you have to identify yourself verbally, sometimes you have to provide something substantial in the way of ID. But the 5th Amendment usually allows you to decline the conversation without being charged with obstruction or anything. That doesn't mean the cop won't get peeved and cobble together something else.

    So what do you say when a local LEO pulls you over and ask, " Mr. Wilson, What are you carrying today?". Told me to slow down a bit. No ticket.

    I thought that ultimately you can't be prosecuted for lying about having a legal firearm... but you are more likely to be held up and dragged across other hot coals of protocol.

    Edit: Ive already made up my mind to inform if asked. I usually keep my weapon in the armrest compartment when driving.

    Sounds like you could tell him what you are carrying and then discuss the price of ammo and firearms.

    WHY? I can understand if it's on your belt, or tucked into your pants (where the cop might see it if you shift around in your seat), but why on earth bring that up if it's in the center console? Just let sleeping dogs lie.

    i hand over my ID but i do not specify if carrying or not, and out of my two LEO encounters, one asked "you have a firearm? where?"(obviously, i responded "yes, hip") the other just handed it back nary a word.

    my real concern is accidentally handing over my ltcf (kept, often stuck to, with my license) while in PRNJ or NY... im sure that'll prompt a search and lock me up for at least a day, if they don't plant anything in my vehicle.
    There is no way to make it out alive...
