    Default About gifting a gun between parent and child.....

    I've learned, through the PAFOA mainly, that it is perfectly legal for a parent to give a child a handgun. I can't find much information though about a child gifting a handgun to a parent. Does anyone know if this too is legal?

    I plan to get my daughter a handgun and license to carry firearms for her 21st birthday. We have a ways to go though, as she's only 18 now. I'm wondering if after she picks out her pistol or revolver and fills out both forms and gets approved but eventually decides the gun is not for her if she could gift it to me. I guess I could fill out the forms in my name and then in time give it to her but that opens the argument of being a straw purchase. Right now were thinking about the M&P 9mm Shield or a Glock 43 which I personally have no desire for.

    It works both ways in PA: Parent to child, child to parent; grandparent to grandchild, grandchild to grandparent; between spouses. These can be handguns or long guns, no paperwork required unless you want to do it that way.

    Assuming both of you live in PA, stay in PA, neither of you are prohibited from possessing a firearm, nor become prohibited in the future your intentions as stated are legal. The gifting rule goes both ways. Two generations up or down. i.e grandparent to grandchild, parent to child, and vice versa.

    The important words are "between" & "and". It doesn't say "parent to child" or "grandparent to grandchild"


    § 6111. Sale or transfer of firearms
    (c) Duty of other persons.--Any person who is not a licensed importer, manufacturer or dealer and who desires to sell or transfer a firearm to another unlicensed person shall do so only upon the place of business of a licensed importer, manufacturer, dealer or county sheriff's office, the latter of whom shall follow the procedure set forth in this section as if he were the seller of the firearm. The provisions of this section shall not apply to transfers between spouses or to transfers between a parent and child or to transfers between grandparent and grandchild.

    So then giving a lower receiver to an 18yo son is fine as well?

    This is the reason I found this site.
    10 years ago I gave my mom a S&W .38 for protection, my wife was flipping out because she thought it was illegal because ... "registration". and I had to prove to her that there was not a registration and gifting between parent and child was lawfull as long as niether were prohibited.
    I gave her an EAA witness a couple of years ago, as the .38 airweight was hard on her hands to shoot, both SA and DA. And my wife flipped out then because now " Semiautomatic"
    I wanted to give her a copy of the PA gun laws and have her learn to understand some of the laws...
