Fatal shooting in Hamilton found to be 'an act of self-defense,' court documents say
A grand jury has decided not to issue an indictment in a fatal shooting that happened late last month in Hamilton, Ohio, court documents state.
After reviewing the evidence presented in the case, the grand jury found that "the shooting was an act of self-defense under Ohio law," according to court documents filed in Butler County Common Pleas Court.
Sgt. Rich Burkhardt said police were called to the 400 block of South Seventh Street at 8:07 a.m. on March 29.
Burkhardt said police believed two men were arguing, and one shot the other. He said one man was found dead at the scene, according to a previous Enquirer report.
Police said a suspect was taken into custody following the incident.

Homeowner shoots naked intruder

LINCOLN COUNTY, W.Va. (WSAZ) - The name of the suspect who broke into a house and was shot by the homeowner has been released.
It happened on Bulgar Road in Alkol Monday just before 2 a.m. Law enforcement say they received a call a naked man was trying to break into a home.
According to West Virginia State Police, Jeffery Roberts II, 28, had broken the door to the residence to get inside. Troopers say the homeowner shot Roberts once in the shoulder. He was taken to the hospital and is in stable condition.

LINCOLN COUNTY, W.Va. (WSAZ) - A homeowner shot a man who tried to break into their home early Monday morning.
Law enforcement responded to the home along Bulger Road in Alkol, West Virginia after receiving a call that a naked man was attempting to break into the home.
While on the way to the scene, law enforcement was informed that the accused intruder had been shot by the homeowner after breaking into the home.
The man was shot in the shoulder and was taken to the hospital.

An alleged home intruder was shot and killed Monday by the homeowner in the Highlands area, according to the Harris County Sheriff*s Office.
The deceased person, who has not been identified, was *known around the neighborhood to have mental health issues,* said HCSO Sgt. D Wolfford.
Police were dispatched around 12:15 p.m. to a disturbance in the 900 block of Jones Road in east Harris County, where a 911 caller said a man was in his house refusing to leave. Another man simultaneously called police from the same location, but dispatchers could not understand the person, Wolfford said.
The shooting occurred while deputies were en route. Upon arrival, the homeowner told authorities that the man walked into his home and was *acing a bit off,* Wolfford said. He said he told the man to leave several times. At one point, the alleged intruder told the homeowner he was going to kill him, Wolfford said.
The homeowner shot him when he saw the man reach into his pocket, Wolfford said.
The case remains under investigation.

BROKEN ARROW, Okla. (KTUL) -- Neighbors are discussing what to do with their families nearly 24 hours after a homeowner fatally shot an intruder in Broken Arrow.
If what happened last night happened at John Lenan*s home, he says there would have been a similar outcome.
*I am a firm believer in the second amendment, I carry, my wife carries," said Lenan.
The Broken Arrow father says he*s not afraid to protect his family.
*We are prepared any time day or night to take care of ourselves," said Lenan.
That*s what Broken Arrow police say a woman did at a home off East Quinton overnight.
Police say two men busted in the front door and were met by the homeowner carrying a handgun.
*The homeowner retrieved a gun and fired it several times striking at least one of the suspects," said Officer Chris Walker.
Walker says when officers arrived they found one man dead inside. The other man got away.
*Naturally if someone kicks in your home they*re there to do you harm," said Walker.
Walker says it*s only the second homicide this year in the city.
By his account, it's a safe place to live, and also a place where thieves should be scared to target.
*If you come kick open my door you*re going to be met with a firearm," said Walker.
*You shouldn*t ask what are you doing here, you shouldn*t fire a warning shot, because if they*re there, they*re there to hurt you," said Lenan.
Lenan says he*s sitting his family down after hearing the shooting last night and has a game plan if someone ever targets his home.
*There are no neighborhoods that are safe; know what to do and prepared to do what*s necessary," said Lenan.
Police have not released an identity on the person killed or any details on the second suspect.

PENSACOLA, Fla. (WKRG) — The man who fired a shot at an alleged intruder inside his house is talking about what happened early Thursday morning on West Jackson Street.
Keith Fendley says the suspects went into the garage and cut off the power to the home and broke through a window in a door that leads to the kitchen. He and his wife were asleep and the glass breaking woke him up.
“I jumped up, got the gun, came right there,” Fendley said.
He poked his head out into the hall and saw two figures in the dark and they told Fendley to put his hands up. He fired one shot hitting Jamarqus Cromwell and that’s when Cromwell and Tayari Crear ran out of the house. One of them had an airsoft gun with them.
Escambia County Sheriff Chip Simmons said Keith and his wife’s granddaughter Cynthia Register planned the home invasion.
“Granddaughter does not go in the house,” Simmons said. “Why? Because she knows grandpa has a gun so she decides to stay outside.”
The Fendleys didn’t know until hours later that she orchestrated it and they were shocked. The six suspects were trying to find money to bail a friend out of jail. Register did apologize to her grandparents.
“You don’t know what to think… you just don’t know,” Fendley said. “Now she did call us from the sheriff’s office just upset as could be.”
The suspect who was shot was injured but Fendley said he would never want to kill anyone. He says he had to protect himself and his wife.
“I don’t own anything here that’s worth somebody dying for, but everything I own here is worth me not dying for too,” he said.
Cromwell was taken to Baptist Hospital and will survive.

Home intruder shot by 66-year-old after breaking into St. Charles apartment, police say
ST. CHARLES, Mo. (KMOV.com) -- Authorities in St. Charles are investigating after a 66-year-old shot an intruder who forced his way into an apartment early Sunday morning.
At 3 a.m., a 66-year-old Sikeston man was asleep inside the Cedarbrook Apartments near West Clay and Zumbehl when he was woken up by yelling and the sound of gunshots outside of the front door. Police said the man was visiting family and did not live there. As he went to get his gun, police said 28-year-old Marshall Funkhouser, of St. Peters, kicked open the door and forced his way in. The two men then exchanged gunfire, hitting each other.
The 66-year-old was shot in the lower abdomen while Funkhouser was shot in the torso. Funkhouser tried to escape but officers found him outside the building. Police said neither the victim or the family who lives in that apartment know Funkhouser.
Both men are still recovering from the shootout at a local hospital.
Prosecutors charged Funkhouser with burglary, assault and armed criminal action. He is being held on a $50,000 bond. Detectives are investigating if there are other suspects involved. Anyone with information should call the St. Charles Police Department at 636-949-3300.

Wapello County Sheriff’s Office Confirms Intruder Shot And Killed By Homeowner
The Wapello County Sheriff’s Office received a report around 9:20PM Thursday night of a man attempting to break into a residence on 97th Ave between Ottumwa and Agency. Upon arrival Deputies discovered a male suspect did forcibly enter the home and was shot by the homeowner.
The suspect was transported by helicopter to the University of Iowa Hospital where he died from the gunshot wound. The Sheriff’s Office is not releasing the identity of the suspect at this time, pending notification of his family.

The shot that hit Terrell Deshawn Brown after a woman said he burst into her home Wednesday and tackled her wasn*t the only one fired. A struggle over the gun ensued with at least four more blasts before he fled, according to new details released in his arrest report.
The 37-year-old victim did not want to talk yet about what happened in her doorway and living room of the North Myrtle Avenue home.
*I*m trying to heal,* she said.
Brown, 24, was arrested a short time later after being treated at a hospital after detectives paired everything together. He lives in the 4600 block of North Ken Knight Drive, about four miles from Wednesday*s shooting scene and the same block where five young men were wounded in a shooting Sunday. Police have not tied Brown in with the earlier incident.
Officers were alerted to Wednesday*s shooting when Brown himself called police about 9:45 a.m. from the 1400 block of McConihe Street, saying he had been shot in the left hip by someone driving by in a Chevrolet with tinted windows as he walked down Myrtle Avenue, according to the arrest report. Officers found him nursing his wound in a chair at the side of the road, saying he did not see the shooter*s face and had no more information on the vehicle.
As officers were talking to him, another call came in regarding a robbery a few blocks away. That victim said someone followed her to her front door, then burst into her home, forcing her to shoot him, police said.
Officers sent to the home learned that the man tried to talk to the victim as she walked to her front door. As she unlocked the door, the man put an arm around her neck and they fell together onto a sofa inside, the report said. The intruder demanded, *Give me everything you*ve got.*
The woman told the intruder that *he can get whatever he*s after* and was allowed to go into her bedroom, the report said. That*s when she grabbed her gun and shot him before they further tussled and gun went off a few more times.
Seven minutes and three blocks later, Brown called police to report he had been shot. He was charged with home invasion robbery without a weapon, police said.

Portsmouth, Ohio. (WSAZ) - Portsmouth Police tell us that a man was shot while breaking into a home on Dunlap Road.
The shooting even came as a surprise to police because they didn*t find out until they were interviewing the suspect that he had been shot.
A woman called police to say that someone broke into her home on Monday while she was asleep.
She heard a noise and went to investigate.
When she was confronted by the intruder, she ran back to her bedroom and got out a gun.
She fired it at the man and then they fought.
The woman escaped and ran to a neighbor for help.
Investigators found the shell casing and even video evidence of what happened from a neighbor*s house.
Brandon Barrett came to the police department afterward and only later told police he had been wounded by the shot.
He was treated at SOMC and has now been charged aggrevated burglary.
He*s now in the Scioto County Jail.

TPD investigates after homeowner shoots, kills intruder on Old St. Augustine Road
The Tallahassee Police Department is investigating after a homeowner shot and killed an intruder early Wednesday.
TPD received a call just after 1 a.m. and responded to a house in the 2800 block of Old St. Augustine Road, near the intersection of Capital Circle SE, where they found a dead adult male.
"We are investigating it as a home invasion, attempted burglary with a shooting," department spokesperson Alicia Turner said Thursday. "The homeowner used deadly force on the suspect after they entered the home."
