A Bradford County man was shot and killed Saturday after investigators say he illegally entered a home in the Town of Nichols and was confronted by an armed occupant.
Deputies were called Saturday to Waite Road in Nichols for a shooting near the intersection with Lynch Road, according to the Tioga County Sheriff's Office.
Deputies and state troopers arrived at the scene and found 29-year-old Cody J. Wagner of Rome, Pennsylvania, in the roadway with a gunshot to his upper abdomen.
Police and emergency medical personnel were unable to resuscitate Wagner and he was pronounced dead at the scene, the sheriff's office said.
A preliminary investigation by the Tioga County Sheriff’s Office Criminal Investigation Division indicates Wagner had unlawfully entered the house at 1958 Waite Road and was confronted by a person investigators describe as a caretaker of the property, who was armed with a shotgun.
The caretaker was a relative who was keeping an eye on the house for the owners, who are out of state, said Capt. Shawn Nalepa from the Criminal Investigation Division.
There had been recent burglaries in the area including at that residence, Nalepa said.
The caretaker attempted to escort Wagner to a nearby residence to call 911, Nalepa said, noting there is no cell service in that area, but before they arrived at the neighbor's house, Wagner was reportedly able to get a revolver out of the vehicle he had driven and pointed it at the other man.
The caretaker then fired the shotgun once, striking Wagner in the upper abdomen, and then immediately went to a location where he called 911, investigators said.
A loaded revolver was recovered at the scene, Nalepa said.
The Tioga County Sheriff’s Office was assisted at the scene by the New York State Police Bureau of Criminal Investigation, Nichols Fire Department, Greater Valley EMS, and Tioga County District Attorney Kirk Martin.
The investigation is continuing and there are no charges against the shooter at this time.

A 12-year-old used a hunting rifle to fatally shoot an armed intruder who was threatening the boy*s mother inside the family*s Louisiana home, a report said.
The youngster, who will not be charged, feared for his mother*s life when he pumped a bullet into Brad LeBlanc, 32, at about 7:20 a.m. on June 30 at their home east of Clinton, East Feliciana Sheriff Jeffrey Travis told The Advocate.
LeBlanc, armed with a pistol, first approached the mother outside their home and then forced her inside the residence where a struggle ensued, the report said.
The armed suspect was then shot by the boy. LeBlanc was declared dead at an area hospital.

A 13-year-old boy carjacking suspect in St. Louis, Missouri, is hospitalized in stable condition after being shot by the alleged victim of the crime. Police say the shooting happened Monday night. A 37-year-old woman was getting out of her car near her home when two young men approached and asked to use her phone. She told them she didn't have one. He was with an older teen, about 16 years old.As the second suspect was trying to start the car, the woman told police the 13-year-old was still pointing the gun at her but became distracted, so she pulled out her own gun and shot him.
"It*s a six-round, and I let the clip loose. All six in fear of my life," the unidentified woman told KSDK. "I am very grateful to be alive."

CHICAGO - An elderly man with a concealed carry license shot and killed a robber in Chicago on Saturday afternoon, police said.
Instead of handing his things over, the elderly man pulled out a gun and shot the robber in the head and chest, police said. He was pronounced dead at the scene. On Sunday, he was identified as Bernard Peterson.
Chicago Police said that the elderly man has a valid Firearms Owner Identification Card and a Concealed Carry License. The Chicago Fire Department confirmed that he is a retired firefighter.

A Chicago homeowner shot and killed a a man Wednesday after witnessing an attempted theft from a vehicle. According to Chicago's WGN9, the unidentified 44-year-old was sitting on his porch when he heard a loud noise. When he left his porch to investigate, he noticed two men under a nearby vehicle, and the shootout began.The Chicago news outlet reported the men were trying to steal a catalytic converter from the vehicle.

A legally armed delivery driver turned the tables on three men who tried to rob him in Philadelphia*s Mayfair section, sending two of them to the hospital in critical condition, according to police.
The man told police he arrived home shortly after midnight on Saturday on Longshore Avenue after working his meal delivery job. After going inside his home to give his family food, he went back outside when he was confronted by three men, police said.
Two of the suspects pointed guns at the man and demanded money. The man then told the suspects the money was inside his vehicle. As one of the suspects searched through the vehicle, the man pulled out his own weapon and opened fire, shooting two of the suspects while the third suspect fled.

ORANGE CITY, Fla. — Police in Orange City believe a woman intentionally hit a motorcyclist and took off before being shot and killed around 5 p.m. Saturday. Investigators say the motorcyclist and several witnesses followed her home, and there was then a confrontation right in her front yard.The motorcyclist, having a valid Florida concealed weapons permit, drew his concealed handgun and fired multiple rounds, striking Morales, a report says.
