    Concealed-carry permit holder acquitted in fatal shooting at Far East Side gas station

    A Franklin County jury decided Friday that a 32-year-old man with a concealed-carry permit was acting in self defense when he fatally shot another man during a confrontation at a Far East Side gas station.

    Nehemiah Martin of the Far East Side was acquitted of murder charges in the Jan. 22 shooting death of 31-year-old Brandon Clark.

    The jury deliberated for less than three hours before returning the not-guilty verdict to Franklin County Common Pleas Judge Colleen O'Donnell.

    Although murder cases rarely go to trial in less than a year even without the Covid-19 pandemic, Martin refused to waive his statutory right to a speedy trial while in jail on a $1 million bond, which meant prosecutors had to bring the case to trial within 90 days.

    "Nehimah was in jail on a sky-high bond," his attorney, Sam Shamansky, told The Dispatch. "We felt that we would be fully available to proceed within the speedy trial guidelines and felt a delay would be prejudicial to my client. Usually the passage of time works to the benefit of the defendant, so this was counterintuitive."

    Shamansky, a veteran Columbus defense attorney, said he has never tried a murder case so soon after the date of the incident.

    Testimony during the weeklong trial revealed that Martin went to the Shell station in the 5900 block of East Main Street, near McNaughten Road, on Jan. 22 for a pre-arranged meeting to pick up his twin boys from the children's mother.

    Martin testified that he was trying to remove the children from their car seats when he was assaulted by Clark, the mother's live-in boyfriend, who had accompanied her to the gas station.

    Martin, who was lawfully carrying a concealed handgun, said he was being beaten so savagely by Clark that he pulled his gun and fired one shot in self-defense.

    Clark was struck in the abdomen. He was transported in critical condition to Mount Carmel East hospital, where he died the next morning.

    After the shooting, Martin went to his grandmother's house, where Columbus police arrested him after he called 911 to report the incident.

    The mother of Martin's twin boys testified against him and in support of her late boyfriend during the trial.

    Clark had been released from prison just four months before his death after serving a six-year sentence for a kidnapping conviction in Franklin County, court records show.

    KANSAS CITY, Mo. * A Kansas City man who admitted to taking part in Independence robbery has been charged in the fatal shooting of his accomplice.

    Antonio D. Johnson is charged with 2nd Degree Murder, Attempted Robbery and Armed Criminal Action. Also charged is Andre D. Mays, Jr. Mays is also facing charges of 2nd Degree Murder, Attempted Robbery and Armed Criminal Action.

    According to court records police officers were called early Thursday morning, April 28, to the 500 block of S. Crescent in Independence to investigate an attempted home invasion by Johnson and Elijah Lockhart, the fatal shooting victim.

    Johnson and Lockhart were confronted by the resident. Lockhart pointed a gun at a man inside the home, several shots were fired at the victim from someone inside the home. Johnson ran from the residence and was taken into custody Friday afternoon.

    Lockhart was found dead just down the street from the crime scene.

    When Johnson was interviewed by detectives, he admitted that he and Lockhart planned on robbing the home on S. Crescent when a confrontation occurred and somebody in the house began firing shots.

    Prosecutors have requested a $150,000 bond for both defendants.

    Prosecutors have ruled the shooting death of a 56-year-old man was self-defense, and for the time being have not charged the shooter.

    According to a three-page memorandum about the incident, prosecutors did leave open the possibility they could re-open the case.

    "If additional information or evidence is provided, this case may be re-evaluated for filing considerations," the memo states.

    "The situation seems odd to me, and to the other people," said Cope's only child and daughter, Caitlin Cope.

    The legal reasoning behind the state's decision

    Prosecutors said they have "to prove beyond a reasonable doubt that the suspect did not act in self-defense and was not in fear for his life when he pulled the trigger and shot the victim."

    State officials said "because the suspect was in a place where he was allowed to be, specifically inside his own home, he had no duty to retreat."

    Reviewing the case, which was presented to them by sheriff's detectives at the conclusion of their investigation, the state said it "cannot meet its burden in proving the suspect was not in fear of his life when he fired the single shot which caused the victim's death; therefore, no criminal charges can be filed."

    Defendant: Punches led to shooting

    The state's report says McKenzie called 911 and told a dispatcher that he shot Cope "because the victim would not stop punching him."

    When Deputy Roger Erwin arrived, McKenzie opened the door and led him to Cope's body. Erwin used a shirt as a bandage and put it where he thought the wound was. He told Cope to lay on the shirt to apply pressure.

    Medical personnel arrived and transported Cope to Ocala Regional Medical Center. Officials said Cope was shot just above the abdomen and the bullet exited the middle of the man's back. Cope later died at the hospital.

    Erwin collected a .357 Smith & Wesson revolver that had five live rounds and spent shell casings. Prosecutors in the report said Cope had scratch marks on his right forearm.

    Neighbor reports horn blowing

    Deputies spoke with a neighbor who said she heard McKenzie's vehicle horn blowing repeatedly between 12:30 and 1 a.m. The woman said when she looked outside, she saw McKenzie was partially outside holding a gun that was pointed at the vehicle.

    The neighbor said McKenzie went to the driver's side and talked with someone.

    McKenzie opened the vehicle's hood and pulled the wires that stopped the honking noise. The woman said she went inside. She said she heard McKenzie and someone arguing and around 1:30 a.m., heard a loud noise.

    The evening began with a meeting at a bar

    Detective Joseph Miller interviewed McKenzie about the shooting. McKenzie said he met Cope at Fire Rock Irish Bar in Silver Springs. He said he had drinks with Cope and a woman who was with Cope. McKenzie said Cope and the woman he was with argued and she left.

    McKenzie said shortly before midnight, Cope planned to leave. He said he and other patrons told Cope he was too impaired and McKenzie offered to take him to his (McKenzie's) residence.

    He said Cope still wanted him to take him to his home. Deputies said Cope lives in Ocala. McKenzie said he told him he did not want to drive that far.

    Driving to McKenzie's home, McKenzie said, Cope told him he wanted to go to his home. McKenzie said Cope punched him twice on the left side of his neck. McKenzie said he started to call 911, and Cope asked him not to call the emergency line. McKenzie said he ended the call.

    Once at McKenzie's home, McKenzie went inside, leaving Cope in the vehicle. McKenzie said the vehicle was making noise and went outside to disconnect the battery. He said he doesn't remember having a gun.

    Not long after, McKenzie said, he heard a knock on the door. He said he opened the door, saw it was Cope and invited him inside. McKenzie said he gave Cope a cup of water. He said Cope punched him in the face three times.

    Falling down, McKenzie said he broke a mirror and cut his hand. McKenzie said he reached for the gun that was nearby.

    He said Cope came toward him and demanded McKenzie take him home or he would take his keys. McKenzie said he was "in fear for his life" and fired a shot. He said he called 911 after the shooting.

    Cope's daughter said while she doesn't disagree that her father may have had a few drinks, he's not a violent person when he's drunk. She said he doesn't mix work with pleasure and he knew he had to work the next day, she said.

    Prosecutors said several pieces evidence recovered from the scene matched McKenzie's story.

    Deceased man's family questions prosecutors' decision

    "Why invite him in his house if he's so violent?" asked the victim's mother, Sarah Patsy Edwards. "It doesn't make any sense. This is not justice for my son."

    Edwards said anyone can invite anyone to their home, kill them, and claim it was self-defense.

    "He could've shot him in the leg. He didn't have to kill him," she said. "He was a good man. He was the only son I got left."

    Caitlin Cope said her father was a medical supplier who made people laugh and was always there for her.

    "He was my go-to person," she said. "It's sad that I can't call him anymore."

    She said her father is originally from Georgia and had moved to Oklahoma. She said her father moved to Marion County in 2018.

    Cope's obituary mentions that in "his spare time you could find Milton on the golf course playing a round of golf, and in Orlando, Florida, at Universal Studios."

    Wife shoots man with knife running toward husband in Madera parking lot, police say
    FRESNO, Calif. (KFSN) -- Madera police are investigating after a man was shot in a Walmart parking lot on Tuesday night.

    Officers were called to West Cleveland Avenue around 9:20 pm.

    Police say two men got into an argument in the parking lot. That's when one of them took out a knife and started running toward the other.

    Investigators say the wife of the unarmed man was sitting in a parked car nearby at the time of the fight. She allegedly pulled out a gun and shot the man with the knife.

    The man was shot in the neck. He was taken to Community Regional Medical Center in downtown Fresno in critical condition.

    Police say the woman thought her husband was in danger and acted in self-defense. Both she and her husband are cooperating with investigators.

    The shooting is still under investigation. It's unclear if charges will be filed.

    ECSO: Woman acted in self-defense when she fatally shot man who broke into Pensacola home
    Criminal charges will not be filed against a woman who shot and killed a man after he broke into her home Tuesday in what authorities have determined was a "stand your ground" case.

    The names of the parties involved in the shooting had not been released as of Wednesday afternoon. Escambia County Sheriff's Office spokeswoman Amber Southard said it goes against ECSO policy to release the name of a victim.

    Escambia County Sheriff Chip Simmons said his agency investigated the shooting and determined the woman acted in self-defense to protect herself and those inside the house — including children — from violence.

    "I think what the unique part of this incident is, is the violent intent," Simmons told the News Journal. "The suspect had an active domestic violence injunction on him, and so, he wasn’t supposed to be there, and he was also reportedly on his way to anger management treatment."

    Assistant State Attorney Greg Marcille said prosecutors agreed with the ECSO's assessment of the incident and will not file charges against the woman.

    "The Sheriff's Office has completed its review into this incident, and they have determined that the individual acted in self-defense to determine that charges are not appropriate," Marcille said. "We were consulted in that decision, and we agree that the individual who fired the shot was acting in self-defense and therefore agree that no charges should be filed."

    Florida law allows people to take reasonable steps, including deadly force, to defend themselves from harm, which is often called the "stand your ground" law.

    Shortly after 5 p.m. Tuesday, Escambia County Sheriff's Office deputies responded to a home in the 8400 block of James Taylor Lane and discovered that a 54-year-old man had been fatally shot by a woman who lived at the residence.

    Detectives obtained video footage from a security camera that was filming the woman's front door and porch area at the time of the incident.

    In a short clip of the footage that the ECSO posted to Facebook on Wednesday, a man can be seen standing on the home's front porch and yelling profanities as he tries to kick down the front door. It took six kicks for the door to break open, at which point the man enters the house and yells "Let’s f---ing play!" before the video ends.

    Simmons told the News Journal there were multiple people inside the home when the man broke inside, including children and at least one person who had a preexisting domestic violence injunction against the man.

    "The injunction was pertaining to an individual who was in the house, but I really can’t say who," Simmons said. "There was more than one person in the house."

    Simmons said after the man entered the house, he armed himself with a knife and began yelling that he was going to harm the children's mother, who was in the house. Witnesses told authorities the man went room to room searching for the occupants who had retreated to a rear bedroom.

    "Once he entered that bedroom, he was confronted by a female who — fearing for her life — shot the man twice," Simmons said.

    Self-defense argument sways jury to acquit man in 2020 fatal shooting

    A San Francisco Superior Court jury on Tuesday found a man accused of fatally shooting another man last year in the city*s Tenderloin neighborhood not guilty after his attorney argued the shooting was in self-defense.

    Robert Brewer, 31, was charged with murder for an Aug. 19, 2020 shooting in the 800 block of O*Farrell Street that killed 44-year-old Contra Costa County resident Darrelle Scales.

    Officers initially found Scales on the sidewalk suffering from a gunshot wound. Despite life-saving measures by officers and medical crews, Scales was ultimately pronounced dead at the scene, police said.

    Officers eventually located Brewer and arrested him.

    In the aftermath of the shooting, Scales* family described him as a *a bright light that could turn anyone*s frown into a smile,* and called his killing senseless.

    During the trial, Brewer*s attorney, Deputy Public Defender Kathleen Natividad, argued that Brewer acted in self-defense when he shot Scales.

    According to Natividad, Brewer had rented a car and was visiting San Francisco to do some shopping. Later that day, as he traveled on foot, he got lost and mistook a different car for his rental car.

    As he approached the vehicle which he thought was his rental car, Scales, the owner of the vehicle, began threatening Brewer. Brewer, however, walked away from the confrontation but Scales continued to follow him on foot for more than two blocks, according to the Public Defender*s Office.

    At one point, Brewer allegedly saw Scales reach for what looked like a shiny object in his waistband, and fearing for his safety, Brewer reached for his own gun and fatally shot Scales.

    According to the Public Defender*s Office, Scales was later found to have an 18-inch metal pipe in his possession.

    Natividad said in a statement:

    *The jury understood that Mr. Brewer was in fear for his life and was acting in self-defense.*

    She added:

    *Situations like this are so complex because you have someone like Mr. Brewer who grew up in an area where he was exposed to so much violence and was only carrying a gun for protection.*

    Public Defender Mano Raju said:

    *I am proud of our defense team who worked hard to demonstrate that this was an act of self-defense. Mr. Brewer would have never fired if he was not in fear for his own life. We are pleased that the jury understood the reality of the altercation and made the right decision.*

    ESCAMBIA COUNTY, Fla. -- An Escambia County man was shot Wednesday morning during a confrontation with a neighbor.

    The Escambia County Sheriff's Office says the shooting is being investigated as a possible "Stand Your Ground" case.

    The incident happened around 10:20 a.m. on Settles Rd. in Molino.

    The man who was shot has been transported a local hospital with non life-threatening injuries.

    Investigators are currently on scene investigating.

    RENO, Nev. (KOLO) - The Douglas County Sheriff*s Office has identified the suspect who was shot early Wednesday morning after authorities said he broke into a home on Alicia Circle and Tilman Lane in Gardnerville.

    The sheriff*s office said the homeowner confronted Christian Gorham around 4 a.m. and shot him. The homeowner detained Gorham until authorities arrived. Gorham was taken to Carson Valley Medical Center and treated and released.

    He was booked into the Minden Jail for Burglary.

    The sheriff*s office said they do not believe the incident is related to a trespassing shooting that happened Tuesday, May 4 in Wellington.

    FRESNO, Calif. (KSEE) * Shots were fired at a Madera Walmart late Tuesday * as a woman attempted to protect her husband from a man threatening him with box cutters.

    Officers with Madera Police were called around 9:00 p.m. to the Walmart on Cleveland Avenue. Officers are yet to release the names of the people involved.

    Surveillance video shows the couple driving away from the Walmart parking lot when the suspect approaches them and some words were exchanged. The man then exits the vehicle, the suspect takes out the box cutters, and begins threatening him. At that moment the man*s wife pulls out a gun and shoots the man going after her husband.

    Investigators say evidence points to the shooting being justified.

    *His wife stepped out of the vehicle, fired one round in fear for his safety, and dropped the individual in the parking lot,* said Madera Police Commander Gino Chiaramonte.

    Officers say the woman called 911 and first responders took the attacker to the hospital, where he is described as in a stable but critical condition.

    Commander Chiaramonte says authorities have not yet interviewed the victim, but so far believe her shooting was justified.

    *In this case, in self-defense, yes, weapons can be utilized,* he said.

    According to Chiaramonte, the gun is registered to the woman but her conceal carry permit has expired. That could mean a misdemeanor charge for carrying the weapon in public.

    Investigators say things could have been worse if the woman had not received firearms training.

    *There*s a certain amount of training that you have to have before you*re able to receive your CCW, and those are the things that are critical,* he said.

    At this point in the investigation, Chiaramonte says they believe that the misdemeanor charge is the only thing she could be charged with. However, the investigation continues.

    VANCOUVER, Wash. — The Clark County Prosecuting Attorney’s Office won’t file criminal charges against a contract newspaper carrier who fatally shot a man last month near the Vancouver waterfront.

    Authorities say the man who was killed, identified as 29-year-old Kin K. Bossy, had been attempting to steal the carrier’s car on April 17 when he was shot multiple times.

    The carrier, identified by police as 35-year-old Justyn Vallandingham, was delivering newspapers in the area of Waterfront Way around 4:30 a.m. He had gotten out of his vehicle to make a delivery and when he returned, he found another man sitting in his car.

    Vallandingham fired at Bossy after finding him inside his vehicle. Following the incident, he called 911 to report it. Police have noted that the delivery driver has a concealed pistol license.

    In a letter Thursday to a Vancouver police detective, Senior Deputy Prosecutor Jeff McCarty wrote that Bossy appeared to be committing a felony offense against Vallandingham, who feared imminent danger or death.
