Suspected home invader critical after Elmore homeowner shoots him 4 times
    Charles Virgil Bowne
WETUMPKA — The suspect in an alleged Elmore County home invasion is clinging to life after being shot several times — including once in the head — by the homeowner.

Charles Virgil Bowne, 39, of Elmore County, was shot once in the head, shoulder, bicep and left leg, said Sheriff Bill Franklin. Bowne was taken by helicopter to a Montgomery hospital with life-threatening wounds, the sheriff said.

The incident occurred about 4:45 a.m. Monday in a home on Clemons Road in the Flatwood community.

"I got a young couple in their 20s; daddy, momma and a young child at home when daddy hears a commotion in the front of the house," Franklin said. "He arms himself with a 9 mm handgun and goes to investigate. He sees Mr. Bowne standing in the living room and Mr. Bowne tells him 'Give me you (stuff).' Mr. Bowne then makes a move like he's going into his front pocket and the homeowner fires several times.

"There was evidence of forced entry into the home. We searched Mr. Bowne and didn't find a weapon, but we did find a crack pipe tucked into his sock."

Less than 24 hours earlier, another resident in the neighborhood filed a complaint against Bowne for allegedly entering his bedroom at about 5:30 a.m. Sunday, Franklin said.

"This neighbor said he woke up to find Mr. Bowne standing over his bed," the sheriff said. "Mr. Bowne drew back his fist several times while yelling 'What's up?' at the man, making a motion like he was going to strike the man.

"Mr. Bowne was lucky he wasn't shot Sunday morning."

Bowne lives in the neighborhood and was recently released from an Indiana prison on theft charges, Franklin said.

The homeowner who shot Bowne likely won't face charges.

"We certainly won't be pursuing any charges against the man," Franklin said. "This man was defending his home and his family. We still operate from the premise in Elmore County that a man's home is his castle. The grand jury will review the case, but we don't expect charges to be coming."

after shooting Middletown man attempting to rob him
    By Lauren Pack
A Middletown man is dead, and his brother and another man are charged with murder following an alleged burglary attempt Wednesday night.

Middletown police were called at 12:02 a.m. Thursday to Atrium Medical Center on a report of a man suffering from a gunshot wound. The man, 25-year-old Joshua Oatneal, died at the hospital, Sgt. Earl Nelson said.

ExploreMiddletown man indicted for woman*s stabbing death and house fire
Police say three people * Joshua Oatneal, his brother Jonathon Oatneal Jr., 23, and Andrew Roberts, 22 * went to a residence in the 2600 block of Aspen Drive to commit a burglary.

During the burglary the homeowner shot Joshua Oatneal. The other two men took him to the hospital and left. They were spotted a short time later in the city, and both are charged with two counts of murder and two counts of aggravated burglary.

Andrew Roberts MIDDLETOWN DIVISION OF POLICE
Jonathon Oatneal and Roberts were arraigned Friday in Middletown Municipal Court. where bond was set at $750,000 each. They are scheduled to be back in court Aug. 28 for a preliminary hearing.

According to court documents, the trio drove to the residence in Riverside Moble Home Park to commit the burglary and robbery. Roberts told police he handed a gun to Joshua Oatneal, and all three ran up to the residence.

ExploreMiddletown man*s death following possible assault ruled accidental
There were two men outside, and Roberts said they told them to get inside and attempted to steal money from James Invey, according to the complaint signed by Detective Steve Winters.

*Roberts advised once inside the residence James Invey started shooting at Josh Oatneal. Roberts advised Josh Oatneal returned fire shooting at victim James Invey,* according to the complaint.

Invey told police Josh Oatneal tried to shoot him, and he was able to arm himself then shot Josh Oatnealin the chest.

Butler County Prosecutor Michael Gmoser said the surviving men in the alleged burglary are charged with murder because they are complicit in the criminal activity that led Joshua Oatneal*s death.

*Because they are complicit in the offense that gives rise to the shooting, even if it wasn*t a shooting by one of the criminals, it is a shooting by the homeowner for the right reason in self defense, they are accomplices and aiders and abettors,* Gmoser said.

The investigation is continuing. Gmoser said he case will likely be reviewed by a grand jury since it is a homicide committed in self-defense.

*The Castle Doctrine gives you the right to exercise self-defense with lethal force when you are in your home or in your automobile, and you are under attack, and you have to have a reasonable belief in that,* Gmoser said.

UPDATE: The Caddo Parish Coroner identified the deceased man as 23-year-old Nikolas A. Mason of the 800 block of Chambers Drive in Shreveport.

Police say when the alleged intruder, later identified as Mason, allegedly opened fire inside the home, injuring the occupant, the homeowner was able to return fire in self-defense and struck the man in the upper body. No arrests have been made and the homeowner has not been charged.

Just after 11 p.m. Tuesday, Shreveport Police responded a report of a home invasion in the 6500 block of Henderson Street.

When they arrived, officers found Mason suffering from a gunshot injury to the upper body.

He was pronounced deceased at the scene.

In addition, officers found an adult female suffering from a gunshot injury to the leg. She was taken to Ochsner LSU Health with a non-life-threatening injury.

Violent Crimes and Crime Scene Investigators at the scene collected evidence and interviewed multiple witnesses.

The preliminary investigation determined Mason allegedly forced his way into the residence while armed with a firearm, and allegedly fired multiple shots, hitting the female in the leg.

A suspect who was allegedly shot by an 85-year-old Cathedral City homeowner in self-defense remained hospitalized Monday, police reported.

The shooting occurred about 6:15 p.m. Sunday in the 38200 block of Chuperosa Lane, according to Cathedral City police Sgt. Albert Ruiz. Patrol officers responded to the house following a 911 call reporting a male intruder had entered the home and threatened the residents, he said.

The suspect, whose name was not released, allegedly “made threats against their lives,” spurring the 85-year-old homeowner to grab his gun and shoot the suspect once in the upper body, Ruiz said.

The homeowners, who were not hurt, did not know the man, police said.

First responders transported the suspect to Desert Regional Medical Center in Palm Springs, where he was listed in stable condition in the intensive care unit.

A protester saved the life of a woman who was shot at as she walked into a San Antonio, Texas, women's clinic on Saturday morning, police said.

Officers responded to gunfire outside of women's reproductive health clinic around 8:30 a.m. CT. While no one was injured, authorities discovered several gunshots to the Alamo Women*s Reproductive Services building.

Protesters who were standing outside the clinic witnessed the shooting, San Antonio police spokesman Chris Ramos said in a press conference. One of them was armed and opened fire on the suspected gunman, who fled the scene, he said.

Authorities don't know if he was wounded as a result of the protester's intervention. The protester had a permit to carry a concealed handgun, according to Ramos.

*He absolutely saved this young lady*s life," he said. "He did something a reasonable person would do and he saw someone engaged in a shooting and he stepped in and intervened and stopped that shooting from occurring.*

While police were canvassing the area to look for the suspected shooter, they found a gun they believe he used in the incident, Ramos said.

Police are investigating the shooting as a possible domestic violence incident because the woman and the alleged gunman know each other.

A day that 'changed the lives of people forever': Trial begins in Marion home invasion
The trial of a 21-year-old Ocala man accused of participating in an ill-fated home invasion robbery nearly two years ago got underway Tuesday morning in front of Circuit Judge Anthony Tatti. The prosecutor told the jury that the events of that one day in July 2019 "changed the lives of people forever."

Robert John Hamilton is charged with two counts of second-degree murder and one count of armed burglary. Hamilton's family and friends were present in the courtroom and sat behind him in the gallery. Those attending the court proceedings had to wear masks and practice social distancing.

In July 2019, deputies said, Hamilton and three other men went to a home in the 14900 block of Southeast 32nd Court Road in Summerfield.

Ocala police case:Ocala man accused of attempted murder

Authorities said Louis Antolin, the homeowner, fired shots from an AR-15 at the people attempting to burglarize his residence.

Nigel Doyle, 22, of Summerfield, and 19-year-old Keith Jackson of Ocala were shot. Jackson, wearing a "Jason" mask made famous by the "Friday the 13th" movie series, died inside the residence. Doyle was taken to a local hospital, where he later died.

Antolin, found in a bedroom, was also transported to a local hospital. He survived.

Sheriff's deputies said they found Hamilton and his alleged accomplice, Seth Adam Rodriguez, in the 15000 block of Southeast 36th Avenue.

    Explaining the charges

Even though the homeowner fired the fatal shots, he was not arrested. Rodriguez and Hamilton were charged with second-degree murder. Florida Statute 782.04 says that charge applies when a person is killed during the commission of a felony crime * in this case, burglary.

Rodriguez, on his 24th birthday on March 29, pleaded guilty to two counts of second-degree murder and burglary of a dwelling while armed or with battery/assault. The Ocala man accepted a plea bargain that called for 35 years in prison.

This was the scene in July 2019 after a botched home invasion robbery led to two deaths in Summerfield.
A day later, Rodriguez had a change of heart and told his lawyer he wanted to withdraw his plea and needed a new lawyer. Tatti appointed a new lawyer for Rodriguez and the process for him to withdraw his plea is ongoing.

On Tuesday, the trial was almost continued by the judge when Hamilton's lawyer, Leonard Klatt of Ocala, showed up half an hour late. He said he forgot his cellphone and went back for it.

Tatti said he was concerned that Klatt had not reviewed some of the evidence and asked Hamilton if he wanted to move along with the trial. After consulting with his lawyer, Hamilton told the court he wanted to continue.

    Prosecutor: Lives changed forever

In his opening statement, Assistant State Attorney Richard Buxman said Hamilton was one of the four people present at the victim's residence. Buxman said before the shooting, Antolin had met Jackson when he sold Jackson a cellphone.

Jackson returned to Antolin's mobile home months later, claiming that his vehicle was broken down and needed help, the prosecutor said. Antolin allowed Jackson to use his cellphone to make a few phone calls.

After the calls were made, Antolin told Jackson he had to leave because he wanted to go to bed.

Buxman said not long after, one of Antolin's doors was kicked in and it "changed the lives of people forever."

The prosecutor talked about the shooting, where two of the would-be burglars died and two others left. Buxman said evidence and testimony proved that Hamilton was at the location. He said the goal was to get the homeowner's guns.

The defense lays out its case

Klatt, in his opening statement, told the jury that Rodriguez pleaded guilty and then recanted. He also said that his client did not want to have anything to do with the incident.

He said when the plan was being discussed, Hamilton was not part of the discussions and wanted out. Klatt said Hamilton "never enters the property," making mention of the victim's large plot of land. He also said that three people were part of the attempted home invasion, and his client was not among the three.

"He was not one of them," Klatt said.

    The homeowner testifies

Antolin testified via Zoom. The judge granted the request because the 63-year-old man suffers from a degenerative disc disease that prevents him from traveling long distances.

Assistant State Attorney Sasha Kidney questioned Antolin. The man said he had six or seven guns inside the home. He talked about meeting Jackson to sell him a cellphone.

Antolin said he saw Jackson again when he came to his home wanting assistance with his vehicle. He said he allowed Jackson to use his phone to make a few phone calls and then told him he had to leave.

Antolin said before going to bed, he heard an explosion. He got his AR-15, saw someone shooting at him, and returned fire.

"It all happened so quickly," Antolin said.

On cross-examination, Klatt asked Antolin how many people he saw, and he said two. He said he never saw anyone else.

    Law enforcement officers testify

The afternoon session for the seven-member jury * four men and three women * saw several present and former sheriff's deputies and Marion County Fire Rescue officials testify for the prosecution.

Prosecutors Kidney and Buxman displayed more than 60 photographs taken at the crime scene. Jurors also saw body camera and in-car videos from deputies.

One video show Deputy Christopher White helping Doyle and assuring him that he will survive his wound. At one point, White said, Doyle asked him "am i going to die?"

In the video shown for the jury, White told Doyle that he had to apply pressure on the wound to his side. He kept telling Doyle to breathe and not move around.

The day ended with jurors viewing photographs of the home, and the volume of evidence that was documented, collected and processed for fingerprints and DNA.

Klatt, in his cross-examination of the sheriff's official talking about the pictures, asked if his client had handled any firearms. The official said that was not her determination.

Klatt then asked if Hamilton's wallet and cellphone, which were among the items seized, proved he committed a crime. The official said she could not say one way or another if Hamilton had been at the location.

Court resumes Wednesday at 8:30 a.m. and the trial is expected to conclude by the end of the day.
