    4106 - Access device fraud

    § 4106. Access device fraud.
    (a) Offense defined.--A person commits an offense if he:
    (1) uses an access device to obtain or in an attempt to
    obtain property or services with knowledge that:
    (i) the access device is counterfeit, altered or
    incomplete;
    (ii) the access device was issued to another person
    who has not authorized its use;
    (iii) the access device has been revoked or
    canceled; or
    (iv) for any other reason his use of the access
    device is unauthorized by the issuer or the device
    holder; or
    (2) publishes, makes, sells, gives, or otherwise
    transfers to another, or offers or advertises, or aids and
    abets any other person to use an access device knowing that
    the access device is counterfeit, altered or incomplete,
    belongs to another person who has not authorized its use, has
    been revoked or canceled or for any reason is unauthorized by
    the issuer or the device holder; or
    (3) possesses an access device knowing that it is
    counterfeit, altered, incomplete or belongs to another person
    who has not authorized its possession.

    I am not a lawyer but my answer is.......No you can never own one.......sorry.

    This isn't a poll though. If you try and are denied you can face new charges more serious than your first.

    Pay a lawyer a few hundred to find out. Then a few thousand if he can REALLY fix it.

    Sounds like you didn't wait on the parking lot, you went in with your tootsie. Either the GF ratted you out as an accomplice which explains the delay of a week, or you gave her up looking for a deal, hence no mention of a conspiracy charge. There's more to this college student days indiscretion than the OP reflects.

    I never said I waited in the parking lot. I was in the store with her. She found out the same day I did, actually. The reason the call came to me first is because I was easier to look up, as I had went and pulled my car around to the front to load up stuff from the cart after ringing out and they got my license plate on camera. My lawyer was able to get the conspiracy charges dropped.

    Either way, as I said, I guess the next step is to speak with a lawyer. It is hopeful though, after research Binder/Suarez v. Holder, there are instances where people have had gun rights restored with similar situations as the one I am in.
