    Default Does involuntary commitent under Act 53 affect gun ownership down the line?

    Article in today's paper about Act 53 providing for treatment for drug addiction and for involuntary commitment when criteria are met. Since it involves drugs I suspect it could affect gun ownership much like a 302 and related. I guess the immediacy of the drug problem is priority, and another way of losing 2nd amendment rights, if that's the case, remote. Anyone familiar with the Act and its long-range affects?

    What is Act 53?

    ACT 53 is a law in the state of Pennsylvania. Act 53 allows a parent/legal guardian to get a drug and alcohol assessment for their child, and if warranted, compel the child to enter treatment.

    Criteria


    • The parent/legal guardian believes that their child has a drug or alcohol problem;
    • The child is unwilling to participate in a treatment program;
    • The child must be a resident of Bucks County; and
    • The child must be between the ages of 12 and 18
    Looks like the act is for kids between 12 & 18. Are under 18 records closed in a background search?

    Depends on the jurisdiction and the provisions written in the law. For example, a kid let's say 15 years of age adjudicated delinquent of a drinking under age charge becomes the subject of Penndot. When he/she obtains a driver's license, at say 19, it is immediately suspended for (I believe) a year. No way around it, and the juvenile record does come into play.

    Apparently not considering the number of people that have come here asking about a 302 they got when they were under 18 and now can't buy a gun.
