    Default Delco LTCF question

    I applied for my LTCF on June 26th at the Delco Sheriff office. Their form says 45 business days but I thought it was 45 days according to the UFA. It has now been 62 days since I applied (according to the date on my receipt). I called them last week to check on the status and all the woman who answered told me is that I would receive a notice in the mail. Does anyone have the section where it lists 45 days, and has there been any court cases decided if the days in the UFA are to be taken as business days or simply days?

    I'm tired of waiting around.

    I think that portion of the law is 6109. (cant remember, am at work - so I cant look it up)

    The law says 45 days, it doesn't say whether business or calender. No known case law to support either side. Your Sheriff could interpret it as he pleases until challenged in court.

    6109 (e) Issuance of license.--
    (1) A license to carry a firearm shall be for the purpose of carrying a firearm concealed on or about one's person or in a vehicle and shall be issued if, after an investigation not to exceed 45 days, it appears that the applicant is an individual concerning whom no good cause exists to deny the license.     DelCo goes by 45 business days. You will get a letter in the mail and then have 6 months to pick it up.

    The DelCo sherriff is known for lack of respect toward law-abiding citizens that want to receive their LTCF. After the 45 business days, keep calling every day and telling them that you would like to know why you have not received it because, per the law you quoted above, they have 45 days to either issue it or let you know why you were denied.

    Reports to the PA Attorney General's office would help as well. Along with NOT voting for the guy when he's up for re-election!

    If you need to cite the 45 day rule it is 18 PaCSA §6109(g):

    (g) Grant or denial of license.-Upon the receipt of an application for a license to carry a firearm, the sheriff shall, within 45 days, issue or refuse to issue a license on the basis of the in*vestigation under subsection (d) and the accuracy of the information contained in the applica*tion. If the sheriff refuses to issue a license, the sheriff shall notify the applicant in writing of the refusal and the specific reasons. The notice shall be sent by certified mail to the applicant at the address set forth in the application.


    e(1) specifies that the investigation must not be more than 45 days but does not say that the investigation must start on the date of application but (g) references from the receipt of application.

    Have they called your references yet? Were they able to get in contact with them? If not they can delay your LTCF.

    I applied for mine in Delco and had it in my hands in 43 days, not business days. I see your tag puts you in Bryn Mawr, if you still live there they might have an issue of what county you are in. I also live in Bryn Mawr and I had to show them a tax bill from Radnor to prove I was in Delco.

    Elmar It took me about 65 days to get my LTCF from DELCO. I got a permit from Utah in less time. You list your home as Bryn Mawr, MONTCO, why did you apply in DELCO?

    unclesam099, I spoke with the Attorney General's (AG) office as to the DELCO Sheriff's ignorance of the firearm laws. The AG, I was told, has no jurisdiction over local Sheriff's, in fact the second part of the post I quoted above in red was what the AG told me, voting the guy out was the only remedy.

    I got mine in about 40-42 days..they contacted both of my references very quickly and VERY early in the morning...that pissed both of them off!

    I'd contact them several times a day to let them know you're not going anywhere until you get your shit. =P

    Unfortunately, the only way out of this predicament with the Delaware County Sheriff is either vote him out of office or, on Day 46 following the application's submission, file for a Writ of Mandamus with the County Prothonotary. The Attorney General can't do anything, but the Court of Common Pleas can. Yes, you can do it without an attorney, but you'll have to do your homework first. And, it might cost some money.
