    Default Question about an AR15 pistol sale?????

    Hi all. Last year I built an AR15 pistol from scratch. I bought the lower and all other parts then assembled. It has a 10.5" upper. Well now I am looking to sell it. My question is: does this gun need to done at an FFL like I was selling a normal pistol or does it fall under a long gun class that I can just sell it with out involving the FFL? Thank you!

    Needs to be engraved with a serial number, model, caliber, manufacturer, and the city/state of the manufacturer. And go through an FFL

    And you could start knocking on the door of being an unlicensed dealer....

    The lower has all of that information. How would I be an unlicensed dealer by selling 1 gun that I assembled personally?

    I see no mention where he purchased and completed an 80% lower so assuming it's a factory lower you have to treat it like a typical pistol and do the transfer.

    Correct. It was not an 80% lower. I just bought everything and assembled it.

    I think he just "built" one from parts. Doesn't sound like he made any of it from scratch and ge didn't mention anything about an 80% lower, so it's just a standard FFL transfer as a pistol.

    Well the second sentence in his first post says "last year I built an AR15 from scratch." So that makes me think me made one from scratch. In my mind, making one from scratch means an 80% lower. But the OP has clarified that he did not use an 80% lower. So obviously the engraving stuff doesn't need to be done

    And the unlicensed dealer part of the post references the new Obama executive order about "people who are in the business of selling firearms." Since it's a gray area, and there are no actual definitions, it's up to the government's interpretation. Manufacturing an AR, and then promptly selling it, could possibly be read as that, imo.

    When something is open strictly to the government's interpretation, I usually take extra care. Maybe you have more faith in the legal system than me.

    Will selling one ar pistol that was built in the past year throw up a red flag? No. But I never said it would. If this is #2 or #3, well then you could be considered. That's why i said "knocking on the door," meaning he should be cautious of it.
